About this file
This is a Justification for Single Source Award document submitted by the Department of Veterans Affairs, Network Contracting Office 23, in support of the Saint Cloud and Black Hills VA Health Care System. The estimated contract value is $99,521.50 for medical gas supplies and services across VISN 23 facilities. The requirement encompasses bulk and cylinder oxygen (USP), medical air (USP), nitrogen (NF), carbon dioxide (USP), helium and specialty medical gases, as well as cylinder leasing, exchange, filling, and distribution services with emergency and routine delivery capabilities.
The justification supports a single-source award to the incumbent contractor under FAR 6.302-2, citing unique qualifications and operational integration as the basis for sole-source procurement. The incumbent maintains the complete cylinder inventory, DOT certifications, established delivery routes, facility access credentials, and emergency response capabilities necessary to provide uninterrupted service. The contracting officer argues that transitioning to an alternative vendor would require extensive removal, replacement, inspection, inventory reconciliation, and onboarding activities that cannot be completed before the current contract expires, and that only the incumbent can ensure immediate, zero-transition continuity essential for veteran/patient care and compliance with NFPA 99 and FDA/DOT requirements. Market research included searches of the SBA VetCert database (178 certified businesses identified), GSA eLibrary (no relevant results), Federal Procurement Database Systems (15,867 VA contracts), and System for Award Management (RAS Enterprises LLC identified with valid registration through March 24, 2026). The document was signed by Contracting Officer Emanuel Nevarez on January 20, 2026, with an effective date of November 15, 2024.

DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Acquisition Plan Action ID: 36C263-26-AP-1527
1. Contracting Activity:
Department of Veterans Affairs, Network Contracting Office 23, in support of the Saint Cloud and Black Hills VA Health Care System.
2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:
The estimated value of the proposed action is $99,521.50
The requirement includes:
• Bulk and cylinder oxygen (USP)
• Medical air (USP)
• Nitrogen (NF)
• Carbon dioxide (USP)
• Helium and specialty medical gases
• Cylinder leasing, exchange, filling, and distribution services
• Emergency and routine medical gas delivery across VISN 23 facilities
VISN 23 relies on continuous, uninterrupted access to medical gases for patient care and other clinical operations. This bridge contract provides critical continuity of supply while the new competitively awarded VISN-wide medical gas contract is completed.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
The incumbent possesses unique qualifications that make them the only contractor capable of meeting Saint Cloud and Black Hills’ urgent and compelling need for uninterrupted medical gas services. The contractor currently maintains the entirety of Saint Cloud and Black Hills’ cylinder inventory, DOT certifications, established delivery routes, facility access credentials, and emergency response capabilities. Their cylinders, regulators, and equipment are already integrated into VA operations, and any attempt to transition to a new vendor would require extensive removal, replacement, inspection, inventory reconciliation, and onboarding activities that cannot be completed before expiration of the current contract. Only the incumbent can provide immediate, zero-transition continuity of critically needed medical gas supplies, which is essential for veteran/patient care, and compliance with NFPA 99 and FDA/DOT requirements. For these reasons, https://www.acquisition.gov/?q=/browse/far/13

the incumbent’s unique readiness and integration support the use of FAR 6.302-2 for this bridge action.
4. Description of market research conducted and results or statement why it was not conducted:
a. Conducted a query on SBA Veteran Small Business Certification (VetCert) using NAICS Code “325120”. The search listed 178 businesses certified as 8(a), 8(a) JV, HUBZone, WOSB, EDWOSB, VOSB, SDVOSB.
b. Conducted a search on the GSA eLibrary for Items: “Medical Gas” which garnered three (3) possible categorial results on the GSA website. The 3 results had no relevance to Medical Gas.
c. Conducted a search on Federal Procurement Database Systems (FPDS) using keywords: “NAICS Code:” 325120” DEPARTMENT_FULL_NAME: ”VETERANS AFFAIRS,DEPARTMENT OF” and produced 15,867 results showing contracts awarded by the Department of Veterans Affairs.
d. Conducted a search on the System for Award Management using UEID: “W4D2BU3BXLK7”. The search displayed RAS Enterprises LLC with a valid SAM registration expiring on March 24, 2026.
5. Contracting Officer's Certification: Purchase is approved in accordance with FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
