SOLE SOURCE JUSTIFICATION UNDER SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL

ITEMS IN ACCORDANCE WITH FAR 13.5

2. Nature and/or Description of the Action Being Processed: This procurement is for a complete

ScriptPro Pharmacy Medication Dispensing System and Robot, manufactured by ScriptPro USA Inc.

in accordance with FAR 13.5 Simplified Procedures for Certain Commercial Items and specifically FAR 13.501 Special Documentation Requirements, where acquisitions conducted under Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6, but still require a justification using the format of FAR 6.303-2. This action will be will be awarded as a firm fixed price contract under the authority of 38 U.S.C. § 8127(c).

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

PHYSICAL CHARACTERISTICS / SPECIFIC NEED/SALIENT CHARACTERISTIC’S:

All line items are Brand Name Only Includes ScriptPro Workflow System, SP 200/CCC (6 slot) Robot, Pharmacy Services Portal, servers, workstations and Inventory Management System along with project management, delivery and onsite training for the new Outpatient Pharmacy. A total of thirteen (13) SP Datapoints are included (one comes with the SP Central Expanded Platform plus 12 additional). The SP Datapoint includes a barcode scanner, monitor, keyboard and mouse. (Qty 6 production area, Qty 3 – Dispensing Window, Qty 2 – Vault, Qty 1 – Procurement tech, Qty 1 - mailing area). Ten (10) SP Printers (label printers. Dispensing windows will not have SP Printers). Three (3) eSIG devices and three (3) wireless scanners for the dispensing window. Two (2) EyeCon 9430s for the vault. Seven (7) KVM switches (Qty 2 - production, Qty 3 – dispensing window, Qty 1 – vault, Qty 1 - procurement). Three (3) 65" Notice Boards: Rx Ready Notice Boards (Main lobby & 2nd floor waiting area), PSP Now Serving Notice Board in Main Lobby. VA to provide compatible networked laser printers.

4. Statutory Authority Permitting Restricted Competition:

FAR 13.5 Simplified Procedures for Certain Commercial Items. The statutory authority for awarding sole source to Service Disabled Veteran Owned Small Business over the simplified acquisition threshold but less than $5,000,000.00 is 38 U.S.C. § 8127(c). The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Competition is restricted on this procurement for the reason below:

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority): The James A. Haley Veterans Hospital and clinics (JAHVH) consists of three outpatient pharmacies located in Tampa, New Port Richey and South Hillsborough that currently use the ScriptPro system in their workflow. This system is the basis of design for the Lakeland CBOC Pharmacy. Request is to outfit the fourth CBOC in the JAHVH network at the Lakeland Outpatient Pharmacy Department as part of the Lakeland CBOC Consolidation Project. Due to the proprietary and highly specialized nature of the system, only the original equipment manufacturer, ScriptPro USA Inc., or their authorized distributor Veterans Healthcare Supply Solutions (VHSS) is capable of supplying the items requested for this procurement. ScriptPro systems are VA Technical Reference Model (TRM) approved as well, which is a requirement for an system that touches the VA Network. There is a current Enterprise Risk Analysis (ERA) completed for the system as well. Additionally, this procurement also requires a Memorandum of Understanding and Interconnection Security Agreement, and Business Associate Agreement due to access to VA sensitive information and VA systems, which has already been approved and is in the eCMS Briefcase as P10. The required software is unique to the facilities existing workstations and software. The LAKELAND CBOC Consolidation requires procurement of additional equipment to support the new clinic and expanded services with an outpatient pharamcy.

This equipment must be consistent with current ScriptPro Systems in JAHVH system for standardization of process and to eliminate the need for excessive training of shared staff and ensure consistent care of Veterans across the JAHVH system. The equipment must include barcode technology to improve safety of dispensing and filling of prescriptions. The equipment must include robotic dispensing to improve efficiency. The DNS of the main facility outpatient Site Parameters (Tampa) need to be standardized and a variation in practice could lead to duplication of cost, errors and hinder patient care, all of which are considered unacceptable risk. The JAHVH has pharmacy

Effective Date: 02/01/2022 Page 11 of 13 technicians and pharmacists that rotate amongst the sites, therefore a vartiation in practice will hinder uniform accuracy controls, training and documentation. Additionally, the equipment must integrate with ScriptPro inventory management system to allow for staff to purchase and manage medications to minimizing shrinkage and spoilage rates. ScriptPro was awarded a national contract in 2020 to provide its ScriptPro Inventory Management (SIM) system to all VAMC customers which utilized ScriptPro software. JAHVH outpatient pharmacies have dedicated substantial time to utilization of this software. Additional time will be needed to replace, rebuild and restock medications, including time, effort and cost to train all staff on how to use the new equipment and to train pharmacy and Biomed personnel on maintenance and repair new equipment and the risk of patient safety due to equipment changes without replacing all in network systems to support standardization, is considered unacceptable.

The product manufacturer ScriptPro USA, INC. holds proprietary rights over the Script Pro software and hardware. This software and hardware is critical to ensure continued compatibility with the existing interface between the Inventory Management and Pharmacy Dispensing units and the Veterans Health Information Systems and Technology Architecture (VistA) in which medication prescriptions are submitted and directly transferred to the units for dispensing. The interface is proprietary to their equipment. A change to another contractor would cause the government to incur additional time and expense and likely require a pharmacy system shut down. Awarding the proposed contract to any other source would require replacing all the currently installed robotic pharmaceutical dispensing equipment and result in unacceptable delays, as well as substantial additional costs to the Government.

This system will allow the pharmacy team to have continuity of care for the patient community while not requiring additional cost and training for the pharmacy team staff. This is the only system with the setup and configuration in the market that meets the government’s needs.

The highly specialized ScriptPro system is the only product that meets the needs of James A. Haley and supports standardization across its network of CBOCs. Standardization promotes increased efficiency and reduces risk in user error which could directly result in patient injury which is determined an unacceptable risk at this time. Personnel time is also saved for pharmacists and technicians as pursuing a different approach would require time for retraining all involved personnel on a new system. Time savings also include the downtime associated with complete system replacements thereby creating additional adverse impacts to supporting patient needs at each of those locations. An approach with different systems that is not standardized for our network creates additional risk to patients as all personnel that rotate amongst the sites will be subject to variations in practices creating unacceptable risks to pharmacy personnel responsible for the accuracy in dispensing medications and the Veteran patients receiving prescriptions again become at risk to injury as a direct result of those variations in practice within our network. This standardization is determined the best risk avoidance in support of safe, efficient, and effective Veteran care by controlling those unacceptable risks mentioned.

Pursuing any other approach would require the same standardization intent and the complete replacement of all similar systems already in place at James A. Haley and supporting CBOCs which we estimate a rough order magnitude of costs savings in excess of to the Government.

The rough order magnitude estimate is created by estimating the 2022 New Port Richey Contract on 36F79719D0135 Delivery order number 36C24822N0923 in the amount of and multiplying by 3 other outpatient pharmacies currently using variations of the same systems (Tampa, New Port Richey, and South Hillsborough).

As evidenced herein, only one source is capable of providing the supplies or services required because the supplies or services are unique or highly specialized; ScriptPro Pharmacy Medication Dispensing System and Robot. Sufficiently clear and convincing evidence shows Veterans Healthcare Supply is indeed the sole SDVOSB Distributor for ScriptPro. A copy of the letter from ScriptPro designating Veterans Healthcare Supply is included in the contract file.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: The Government has determined that the sole source to the SDVOSB distributor is in the best interest of the James A. Haley Veterans’ Hospital and the Government. The requested product features highly specialized unique characteristics as outlined above.

A notice of intent to sole source will be publicized in accordance with FAR subpart 5.2 along with a redacted and unsigned copy of this justification. The signed copy is on file.

It is determined to be in the best interest of the Government to procure this requirement via SDVOSB sole source in accordance with the cited statutory authority.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: The anticipated cost is determined to be fair and reasonable through comparison with other market research price estimations.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted: Market research was conducted by reviewing similar order and using: sam.gov and searching contract opportunities for similar requirements, fpds.gov and searching similar requirements.

The ScriptPro system has highly specialized unique features as highlighted above that are paramount to veteran support within the JAHVH network and CBOCs. Market research validates that there is one (1) single source SDVOSB authorized distributor of the required equipment. In addition to the information provided elsewhere in this document, market research was conducted by researching the proposed acquisition using the NAICS code and by searching SBA DSBS, SBA VetCert, FPDS, GSA, the VA Supply Chain Management Catalog, and contractdirectory.gov.

There is absolute confidence that no other qualified sources capable of provided the required Brand Name Only equipment as evidenced by the sole source letter provided by the OEM, ScriptPro. It is determined that a sole source award to the Service Disabled Veteran Owned Small Business is in the best interest of the Government (reference statutory authority in paragraph 4 above).

These highly technical computerized and robotic information technology systems are considered exempt from BAA. Reference FAR 25.103(e) Information technology that is a commercial product.

Market research of similar acquisition history provides additional support to sole source the necessary ScriptPro equipment as part of the James A. Haley Veterans Hospital network including its CBOCs. E.g. refence the sole source procurement to ScriptPro for similar equipment on GSA Contract 36F79719D0135 Delivery order number 36C24822N0923 in the amount of .

9. Any Other Facts Supporting the Use of Other than Full and Open Competition: There are none. All facts as currently known are listed herein, including but not limited to the statutory authority to

10. Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: No other sources are authorized distributor of the required product as sufficiently evidenced herein.

11. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to

Competition before Making subsequent acquisitions for the supplies or services required: No additional future requirements are planned at this time. Any possibility of future competition will depend on industry and market availability. No additional action is considered necessary by the agency.

12.
