About this file

This document is a single source justification for the Department of Veterans Affairs to procure the Magnet Recognition Program from the American Nurses Credentialing Center. The Long Beach VA Healthcare System requires the Magnet Recognition Program to designate its organization as achieving nursing excellence. Only the American Nurses Credentialing Center can provide the proprietary Magnet designation due to exclusive trademark licensing agreements. Limited market research was conducted due to urgency and time constraints to support the hospital's Magnet Recognition Program. The contracting officer certified the single source procurement in accordance with FAR 13.106-1(b). The estimated amount for the Magnet Recognition Program is $32,750. The related federal contract opportunity is a special notice of intent to sole source the Magnet Credentialing Program from the American Nurses Credentialing Center issued by the Department of Veterans Affairs Veterans Health Administration Veterans Integrated Service Network 22.

Last Updated: 02/01/22 Page 1 of 2

DEPARTMENT OF VETERANS AFFAIRS

Justification for Single Source Awards IAW FAR 13.106-1 For

Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)

Commodity Brand Name Description:

• Brand Name: American Nurses Credentialing Center

• Description: Magnet Recognition Program ® for the Long Beach VA Healthcare System (LBVAHCS) – Long Beach, CA.

Acquisition Plan Action ID: 36C262-24-AP-0577

1. Contracting Activity: Department of Veterans Affairs, VISN 22, Network Contracting Office 22 (NCO 22) in Long Beach, CA, seeks to procure brand name only unrestricted single source American Nurses Credentialing Center – Magnet Recognition Program ® listed in purchase request 600-24-2-078-0004 at/for the LBVAHCS, Long Beach, CA.

2. Brief Description of Supplies/ Services required and the intended use/Estimated Amount:

LBVAHCS has a requirement to purchase American Nurses Credentialing Center (ANCC) – Magnet Recognition Program ® (brand name only).

Estimated Amount: $32,750.00 USD.

3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:

The American Nurses Association (ANA) American Nurses Credentialing Center (ANCC) offers the Magnet Recognition Program ®. This proprietary trademark designates organizations worldwide where nursing leaders successfully align nursing strategic goals to improve the organization’s patient outcomes. The Magnet Recognition Program ® is an organizational credential to recognize healthcare facilities that have demonstrated nursing excellence. The program does not subcontract or have authorized distributors to provide the Magnet ® designation.

However, due to urgency, time constraints, and exclusive trademark licensing agreements of proprietary requirement in support of hospital Magnet Recognition Program ®, only ANCC can meet agency need. VA Rule of Two does not apply.

Circumstances of contract action deem brand name only available, and no other supplies or services will meet agency need due to the trademark / proprietary nature of certification recognition program. Additionally, following established protocols for competitive procurement would result in unacceptable delays and place Veteran patient care at risk.

4. Description of market research conducted and results or statement why it was not conducted:

Limited market research (MR) performed due to urgency, time constraints, and exclusive trademark licensing agreements of proprietary requirement in support of https://www.acquisition.gov/?q=/browse/far/13
