VHAPG Part 813.106 Simplified Acquisition Procedures: Soliciting from a Single Source Attachment 1: Single Source Justification for SAP under the SAT
Last Updated: 02/01/22 Page 1 of 2
DEPARTMENT OF VETERANS AFFAIRS
Justification for Single Source Awards IAW FAR 13.106-1 For
Over Micro-Purchase Threshold but Not Exceeding the SAT ($250K)
Commodity Brand Name Description:
• Brand Name: Artemis System
• Description: Upgrade Artemis Software for Transperineal Biopsy (BX) for the Southern Arizona VA Healthcare System (SAVAHCS) – Tucson, Arizona.
Acquisition Plan Action ID: 36C262-23-AP-3458
1. Contracting Activity: Department of Veterans Affairs, VISN 22, Network Contracting Office 22 (NCO 22) in Long Beach, CA, seeks to procure the supplies / services listed in purchase request 678-23-2-071-0062 at/for the SAVAHCS, Tucson, Arizona.
2. Brief Description of Supplies / Services required and the intended use / Estimated Amount:
Upgrade Artemis Software for the Transperineal Biopsy (BX) to Windows 10.
Estimated Costs: $68,000.01 USD.
3. Unique characteristics that limit availability to only one source, with the reason no other supplies or services can be used:
Limitations are imposed by the Operating room to purchase Transperineal upgrade attachment to current HD Artemis system and Artemis Software Upgrade. The Artemis workstation needs to be upgraded to Windows 10 as it is no longer supported by current windows system. Current equipment cannot be used until additional software upgrade and attachments are updated. This is creating a work stoppage and is delaying further surgical interventions. Artemis is a Magnetic Resonance Imaging (MRI) ultrasound (USG) fusion system used to perform prostate biopsies. It’s a prostate cancer detection and can detect more cancer than standard trans-rectal ultrasound-guided biopsies. Circumstances of contract action deem only one source reasonably available due to urgency, time constraints, and critical and unique nature of requirement per FAR 13.106-1(b), and no other supplies or services will satisfy agency requirements. Additionally, following established competitive procedures would result in unacceptable delays with increased risk to patient care.
4. Description of market research conducted and results or statement why it was not conducted:
Limited market research (MR) performed due to urgency, time constraints, and critical / unique nature of requirement. Results from SBA VetCert and VIP query by applicable North American Industry Classification System (NAICS) code 334510 identified 282 SDVOSB / VOSB vendors who could potentially perform the requirement. However, VA Rule of Two does not apply and there is no reasonable expectation that 2 or more qualified SDVOSB / VOSB vendors can or would submit https://www.acquisition.gov/?q=/browse/far/13

Last Updated: 02/01/22 Page 2 of 2 offers to meet mission need. Conclusion – recommend single / sole source award to Eigen Health Diagnostic & Therapy [SAM UEI: KFBQNKZHLJZ6], a SAM / SBA / small business vendor who is familiar with the requirement, maintains needed expertise, and routinely provides repairs on existing equipment.
5. Contracting Officer's Certification: Purchase is approved in accordance with
FAR13.106-1(b). I certify that the foregoing justification is accurate and complete to the best of my knowledge and belief.
