About this file

This is a Sole Source Justification for a Federal Supply Schedule (FSS) acquisition by the Department of Veterans Affairs, Network Contracting Office 2, located in Buffalo, New York.

The acquisition establishes a service maintenance agreement for the ScriptPro Space Combo Robotic Prescription Dispensing System and associated accessories across nine VISN 2 VA Health Care System facilities in New York. The proposed contractor is ScriptPro USA, Inc. (5828 Reeds Road, Mission, KS 66202-2740), ordering against FSS Contract Number 36F79719D0135. The estimated contract value is $1,486,679.80 with a performance period from October 1, 2026, through September 30, 2029. Pricing breaks down as follows: Base Year $483,228.52, Option Year 1 $501,725.64, and Option Year 2 $501,725.64. The requirement covers ongoing maintenance, technical support, and software update services for the robotic pharmacy automation system currently installed at the specified facilities, including 24/7 helpline support and onsite service technician dispatch within 24 hours.

The justification cites GSAM 538.7104-3(b)(1)(iii)—logical follow-on to an original FSS order—as the authority for sole source procurement. Market research determined that ScriptPro USA, Inc. is the only company capable of providing maintenance services on this specialized, proprietary equipment due to its integration with existing pharmacy systems and the need for manufacturer-specific expertise. The justification notes that overcoming competitive barriers is not feasible while the VA continues using ScriptPro equipment, though alternative sources will be researched as system components near end-of-life. All required certifications and approvals have been completed, including review by the VHA RPO HCA for orders exceeding $900,000.

This action is required for on-going maintenance, technical support, and software update services on the ScriptPro Robotic Pharmacy Automation System located at VISN 2 facilities listed herein. The current contract: 36C242F0018. ScriptPro equipment is used to automate the filling of prescriptions and to serve as a workflow management tool with the Pharmacy Department to provide accurate, verified, and efficient drug dispense by use of state-of-the-art robotic technology. 4. Identify the Authority and Supporting Rationale (see below and if applicable, a demonstration of the proposed contractor’s unique qualifications to provide the required supply or service.

GSAM 538.7104-3(b)(1)(i): An urgent and compelling need exists and following the ordering procedures would result in unacceptable delays:

GSAM 538.7104-3(b)(1)(ii): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized;

GSAM 538.7104-3(b)(1)(iii): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order provided that the original order was placed in accordance with the applicable Federal Supply Schedule ordering procedures. The original order must not have been previously issued under sole source or limited source procedures.

GSAM 538.7104-3(b)(1)(iv): It is necessary to place the order with a particular FSS contractor to satisfy a minimum guarantee established in the FSS BPA; or

GSAM 538.7104-3(b)(1)(v): A law expressly authorizes or requires that the purchase be made from a specified source.

GSAM 538.7104-4: Items peculiar to one manufacturer:

5. Describe Why You Believe the Order Represents the Best Value consistent with GSAM 538.7102-2(4) to aid the contracting officer in making this best value determination:

The individual services for this requirement are priced on VA FSS Contract 36F79719D0135 and have been determined to be fair and reasonable at the time of award. This order is the best value for VISN 2 Pharmacies because it provides service to maintain their HTME equipment. The customer technical support plan includes software updates, hardware updates, routine inspections, and maintenance, 24 hour, 7 days a week helpline for software, hardware, and user questions. Onsite service technicians are dispatched within 24 hours if required with all costs included. Substantial administrative cost savings are also realized by establishing a contract which allows repair services as needs arise. This significantly reduces the time for both Contracting personnel and Biomed personnel in annual procurement costs.

6. Describe the Market Research Conducted among schedule holders and the results or a statement of the reason market research was not conducted.

Market Research was conducted and encompassed all required sources of supplies and services to include GSA and the VA Federal Supply Schedule. A determination was made that no other manufacturer can meet all salient characteristics outlined in the requirement.

This requirement can only be provided by the manufacturer because of the proprietary information of the precision electronic equipment and the associated software. However, GSA Advantage/e-buy were used to determine if there were any other sources of providing ScriptPro maintenance services. It has been determined that ScriptPro USA, Inc., is the only company capable of providing these services on this specialized, proprietary equipment.

7. Any Other Facts Supporting the Justification:

ScriptPro has successfully provided these same services at the same locations since this equipment was installed.

8. A Statement of the Actions, if any, the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made:

Overcoming barriers to competition for this service agreement is not feasible so long as the VA continues to utilize ScriptPro as a source of the equipment. As the system’s major parts near the end of their lifecycle, other sources will be researched that can possibly replace or compete with ScriptPro.

9. Requirements Certification: I certify that the requirement outlined in this justification is a

Bona Fide Need of the Department of Veterans Affairs and that the supporting data under my cognizance, which are included in the justification, are accurate and complete to the best of my knowledge. I understand that processing of this sole source justification restricts consideration of Federal Supply Schedule contractors to fewer than the number required by GSAM 538.71 as directed by FAR 8.4.
