About this file

This is a Justification for Exception to Fair Opportunity (J&A) under Federal Acquisition Regulation (FAR) Part 16.5 for a modification to an existing Defense Information Technology Contracting Organization (DISA) contract.

The procurement concerns the Financial Accounting Management Information System – Working Capital Fund (FAMIS-WCF) Sustainment and Enhancement, modifying existing contract HC104718D2005 and delivery order HC104722F0001 under a firm fixed-price agreement. The modification will provide continuous support for agnostic cloud migration, Business Enterprise Architecture (BEA) compliance, Web Services integration, and System Rationalization for three operating units: Working Capital Fund (WCF), General Fund (GF), and United States Space Force (USSF). The justification cites FAR 16.507-6(b)(3)—sole source basis in the interest of economy and efficiency—as the regulatory authority for this exception to fair opportunity. The contracting activity is DISA, Defense Information Technology Contracting Organization, PS62. The current contractor is identified as the only source capable of fulfilling requirements without risk of substantial service disruption to DISA's core financial system. Key concerns preventing competitive rebidding mid-migration include: onboarding delays of 1.5 months, system familiarization delays of 4.5 months, and total schedule risk of 6.0 months. The contractor possesses irreplaceable end-to-end knowledge of FAMIS-WCF's technical architecture and DISA's integrated business processes. Transitioning vendors mid-migration would result in split responsibilities, mission failure risks, communication breakdowns, and cost duplication. The original task order HC104722F0001 was competed as full and open competition under the DISA SETI IDIQ contract. The Government determined existing hourly rates for fixed-priced services were fair and reasonable, with pricing consistency to existing labor categories and rates on the SETI IDIQ contract. Plans for follow-on competition are in the market research phase, scheduled after successful cloud migration completion.

THAT LED TO THE EXCEPTION TO FAIR OPPORTUNITY: The Contracting Officer has reviewed the previous J&A, which was routed with this J&A, and determined any planned actions to remove barriers to competition listed on the previous justification were considered. The recompete is in the market research phase, with plans to award after a successful migration.

Procurement History.

(a) Task order HC104722F0001 was competed as a full and open competition under the DISA awarded SETI IDIQ and was the only acceptable offeror.

(b) The PMO has every intent to lay out a strategy and perform acquisition activities for the follow-on contract to ensure that adequate competition is achieved for this effort. At the time other alternatives will be evaluated, and DISA will take every step possible to promote a competitive environment.
