About this file
This document is a memorandum justifying the use of other than full and open competition for an acquisition under the simplified acquisition threshold. The requirement is for Composite Fire Protection Panels - Access Doors for Rescue Padeyes, which are proprietary components of the Rapid Access Composite System installed on the EPF Class vessels manufactured by CBG Systems. CBG Systems is the only source capable of providing these items, as they possess the required proprietary rights, drawings, and manufacturing details. The justification cites FAR 13.106-1(b)(1)(i) for purchases not exceeding the simplified acquisition threshold, where a Contracting Officer may solicit from a single source if it is the only reasonably available source. The related federal contract opportunity is for the USNS CODY (T-EPF 14) Access Hatch Panel Doors for Rescue Padeyes, solicited by the Department of the Navy Military Sealift Command.

MEMORANDUM
Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN ACQUISITION UNDER
THE SIMPLIFIED ACQUISITION THRESHOLD
Ref: (a) PR Number(s): 1301128124
I. BACKGROUND:
1. In considering the references, FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contacting Officers may solicit from one source if the Contracting Officer determines that, under the circumstances of the contract action, only one source is reasonably available (e.g., urgency, exclusive licensing, brand-name, or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition because only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE:
1. Provide a description of the item or service required, to include
a) the name of the required source or brand name
Composite Fire Protection Panels- ACCESS DOORS FOR RESCUE PADEYES
b) the required delivery date/period of performance and
c) its intended use.
The requested hatches are part of the Rapid Access Composite System installed on board the EPF Class manufactured by CBG Systems. This system is a fire boundary to help protect the aluminum structure in case of a fire. The details in manufacturing the Inspection Hatches are provided on drawing number SFPHAT- ACC-200-200 and are clearly marked as proprietary information. The need for CBG System to manufacture and deliver these doors is to maintain the fire boundary integrity of the Rapid Access Composite System.
2. List the source(s) or known vendor(s) who are able to provide the above described item or service.
CBG Systems PTY LTD 09 Bender Drive Derwent Park Tasmania, Australia 7009
