About this file
This is a Memorandum for the Record documenting a sole source justification for a simplified acquisition threshold procurement. The acquisition is for MTU repairs and 6,000-hour (6k) maintenance services for main engines, with a period of performance from September 1 through October 31, 2026. The required source is MTU America, Inc., identified as the Original Equipment Manufacturer (OEM) for the main engines. The intended use is to repair exhaust bellows and injector cups while performing scheduled 6k maintenance. The memorandum does not identify whether the equipment qualifies as critical ship equipment per COMSCINST 4490.1 and SMS Procedure 10.6-002-ALL, and the Independent Government Estimate section is left blank.
The justification for sole sourcing is based on two primary factors: restrictive rights and exclusive licensing agreements. The memorandum establishes that MTU America holds proprietary rights and that all work must be performed by the original manufacturer, as factory-authorized representatives possess proprietary data necessary to conduct the repairs and maintenance. The determination selects both the "Only One Responsible Source" and "Exclusive Licensing Agreements" options, with the OEM explanation noting that MTU America is the sole source capable of performing the required work. No alternative sources are considered viable due to the proprietary nature of the work and the manufacturer's exclusive control over technical specifications and procedures.

The determination that the procurement for the above is an urgent requirement is based on the following:
