About this file
This is a Memorandum for the Record documenting use of other than full and open competition for a simplified acquisition threshold procurement.
The acquisition concerns T-ALT 0169/WI 504 Steering Gear Mod Material Procurement for USNS Lucy Stone FY 27, with PID Number N32205-26-SIMACQ-DSM-PM1-0146. The required delivery date is October 1, 2026. The sole source identified is Macgregor USA, Inc., the Original Equipment Manufacturer that owns all proprietary rights to the dimensional, material, and manufacturing details of the steering gear modification materials. The determination for sole source procurement is based on restrictive rights, specifically that Macgregor USA owns exclusive intellectual property rights to the product specifications. Additionally, standardization requirements per COMSCINST 4790.3 support this determination to maintain fleet configuration baseline, with the same Make and Model (5142-A-000) installed on other vessels including USNS Oscar V. Peterson (T-AO 206). The product is identified as critical ship equipment where failure poses a hazard to the ship, crew, or environment per COMSCINST 4490.1(series) and SMS Procedure 10.6-002-ALL. Section 4, Certifications and Approvals, is redacted in the document.
