About this file

This is a Memorandum for Use of Other Than Full and Open Competition, specifically for the procurement of sea valves for the USNS WASHINGTON CHAMBERS (T-AKE-11). The document justifies a sole-source procurement from Ladish Valves for sea valve replacements, with a required delivery date of 09/30/2025. Multiple justifications are provided for the single-source procurement, including: proprietary rights to valve drawings, critical ship equipment status, standardization requirements, and the specialized design of T-AKE class sea valves that necessitates using original equipment manufacturer (OEM) representatives.

Key procurement details include the specific valve model (Ladish Valves/5235-3051-TT01-A10A), the intended use of replacing corroded/damaged sea valves while the ship is in dry dock, and the determination that only Ladish Valves can provide technically compatible replacement parts. The procurement is driven by the need to maintain vessel equipment in accordance with OEM recommendations, Military Sealift Command (MSC) policy, and regulatory body requirements. The document emphasizes that MSC lacks the manufacturing and technical information to evaluate non-OEM replacement parts as equivalent to the original components.

b. Identify the distributor / authorized technical representative for the item or service.

Provide evidence of the exclusive licensing agreement as an attachment to this document.

(NOTE: If there is more than one distributor / authorized technical representative, then use Part B – Brand Name.)

3. X OTHER REASON:

a. X CRITICAL SHIP EQUIPMENT: The required item is critical ship equipment, the failure of which poses a hazard to the ship, the crew or the environment.

i. SMS Procedure Number: 10.6-002-01-AKE

ii. Describe how it applies to the critical piece of equipment: Ensures that vessel equipment is maintained in accordance with original equipment Manufacturer (OEM) recommendations, MSC policy and regulatory body requirements.

b. _X STANDARDIZATION / BRAND NAME: Per MSCs standardization initiative, only the specified make/model of the equipment/parts will satisfy the Government’s needs for additional units or replacement items.

i. Identify Make / Model Number(s): Ladish Valves/5235-3051-TT01-A10A

ii. Identify other vessels with this Make / Model:

T-AKE CLASS

c. X FORM, FIT, AND FUNCTION: Item is direct replacement parts / components for existing equipment and must be compatible in terms of form, fit, and function with existing equipment / configurations.

ii. Describe how the equipment must be compatible with the existing configuration.

3 Ver 2.0 (01 July 2018)

Different valves have different face to face dimensions keeping with the same make and model will reduce the need to modify the piping upon installation.

d. X OTHER:

MSC does not have manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts offered are equivalent to the OEM components and replacement parts offered are equivalent to the OEM components and replacement parts. The design of the T-AKE sea valves was developed specifically for the T-AKE Class; only approved technical representatives and providers are authorized to service this equipment. OEM Reps have access to provide parts and technical data/drawings from the original manufacturer as required by USCG and ABS certification for maintenance.

4. UNUSUAL AND COMPELLING URGENCY: The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits. Urgent requirements are supplies or services that will result in work stoppage, or are mission critical and the routine processing time would injure the Government. The determination that the procurement for the above is an urgent and compelling requirement is based on the following:

a. Date on which the requirement was identified:

b. Required delivery date / Period of Performance:

c. If the difference between a. and b. is more than one week, explain the delay in submitting the requirement.

d. Estimated production lead time:

e. Explanation of why delivery / commencement of services by the date required is needed: (explain the impact to the mission, any special circumstances or conditions, etc.)

f. CASREP Number:

IV. ANTICIPATED DOLLAR VALUE OF PROCURMENT:
