About this file

This is an Intent to Sole Source letter from the Montana Department of Administration, State Procurement Services Division, on behalf of the Montana Highway Patrol under the Montana Department of Justice, seeking to award a sole source contract to INTOXIMETERS, INC for the SoToxa Drug Screen Device and associated supplies and equipment. The procurement is for oral fluid testing equipment designed for roadside drug screening to establish probable cause for arrest. The device must be portable, handheld, rugged, and capable of immediate testing in the field, with a reliable power source including a car charger to support operations across Montana's large rural geography. Implementation is required by July 1, 2026. The solicitation opened on May 18, 2026, and closes on May 29, 2026, at 2:00 p.m. Mountain Daylight Time. Interested vendors are invited to submit written comments through the eMACS procurement system demonstrating their ability to provide equivalent products and services meeting all specified requirements. Questions should be directed to Peter Steinman at Peter.Steinman@mt.gov or (406) 444-2026.

The budget for this procurement is approximately $900,000. The sole source justification is based on Montana State Legislature approval of oral fluid testing as a roadside screening method, the critical requirement for immediate testing to prevent drug elimination and maintain evidence integrity, and the need for equipment specifically designed for maximum operational utility in a large, rural state requiring extended patrols. The State reserves the right to issue a competitive solicitation if evidence presented reveals more than one source is available to provide the product and services. If no evidence is presented by the deadline, the State may proceed to award the contract to Abbott Laboratories as an alternative.

To All Interested Vendors:

The Department of Administration, State Procurement Services Division, is considering a request from the Montana Highway Patrol of the Montana Department of Justice, to award a Sole Source contract to INTOXIMETERS, INC for SoToxa Drug Screen Device and associated supplies/equipment. The determination for this Sole Source purchase is based on the following requirements:

1. The Montana State Legislature has approved the use of Oral Fluid Testing as a roadside screening method to determine the presence of drugs and establish probable cause for arrest. The device must be portable and capable of immediate roadside testing due to the following critical requirements:

· Law enforcement cannot unreasonably detain individuals by transporting them to an office or jail to conduct a screening test before making an arrest determination.

· Testing must be performed immediately upon demand to mitigate the risk of drug elimination over time, which is essential for maintaining accurate results and preventing challenges to evidence integrity in court proceedings.

2. Needs implementation by 7/1/2026

3. Budget is about $900,000

4. Given Montana's large, rural geography, which requires Montana Highway Patrol (MHP) troopers to travel great distances, the equipment must be designed for maximum operational utility:

· The device must be a rugged, ultra-portable/handheld unit that supports immediate deployment and efficient storage.

· The device must include a reliable power source, specifically a car charger, to ensure continuous operation and maximum availability across extended patrols.

The State Procurement Services Division will accept written comments from potential vendors who believe they have the ability to provide an equivalent product and services, meeting all of the requirements listed above. This is not a request for competitive proposals. Vendors interested in providing this product to the State of Montana are invited to provide a detailed description of their product. Written comments must be received by 2:00 p.m. local time, 5/29/2026. Responses to this notice must be submitted within the eMACS procurement system. Questions can be submitted on the Q&A board in eMACS or directed to:

Peter Steinman Peter.Steinman@mt.gov A determination by the State not to compete this proposed purchase based upon responses to this notice is solely within the discretion of the State. If evidence presented reveals that more than one source is available to provide the product/services, the State may issue a competitive solicitation. If no evidence is presented in the timeframe specified, the State may proceed to award a contract to Abbot Laboratories.

Thank you for your interest.
