About this file
This document is a Justification for an Exception to Fair Opportunity for the procurement of Opus Suite consulting services in support of the United States Marine Corps Program Manager, Ground-based Weapons Systems (PM GWS).
The key details are: The Opus Suite software developed by Systecon is critical to supporting PM GWS' evaluation of system utilization, maintenance, and sparing requirements. Systecon is the only organization that can provide the required expertise and access to the proprietary software code to meet the modeling requirements. A sources sought notice was posted, but only one interested party responded without submitting a capability statement. The contracting officer will ensure the services are procured at a fair and reasonable price through price analysis. There are no plans to compete future contracts for these services, but the government will continue market research to determine if additional sources become available.

In support of desired outcomes for the United States Marine Corps, it is critical that the support services encompass a holistic data model of the system enterprise, to include system components, maintenance tasks, and sparing requirements. As stated above, the Opus Suite model will support PM GWS in evaluating “what-if” scenarios for system utilization and subsystem requirements. Predictive modeling in Opus Suite will identify necessary changes in areas of product support, resulting in positive availability impacts and projected cost avoidance.
The support services will provide PM GWS leadership with Opus Suite modeling and simulation development and subject matter expertise to understand costs and evaluate return on investment.
Opus Suite will specifically identify and support many of the cost reduction objectives identified and discussed within PM GWS and based on Systecon’s past participation with MARCORSYSCOM, the contractor is the only organization that can successfully provide this level of expertise with this type of software. The unique nature of this requirement demands the developers of the software be involved in order to be able to manipulate the proprietary part of the software, the contractor’s code, to meet the modeling requirements for PM GWS. There are no known competitors that have the required intellectual property, and the Government does not have sufficient rights to the intellectual property to allow another entity to provide the required services.
5. Fair and Reasonable Price Determination
The Contracting Officer will ensure that the services procured in connection with this justification are at a fair and reasonable price. The contracting officer will determine the proposed price to be fair and reasonable using the price analysis method described at FAR 15.404-1(b)(2)(v), comparison of proposed prices with IGCEs. Furthermore, the Contracting Officer will seek additional cost savings, where possible.
6. Other Facts Supporting the Justification
Market research revealed that other companies did not have the intrinsic knowledge of PM GWS equipment that Systecon has as a software developer. Prior market research by another military component’s program office confirmed that because of Systecon’s unique knowledge and capabilities as a software developer, there is no reasonable expectation that there would be two or more offerors capable of performing this requirement.
Additionally, in accordance with Defense Federal Acquisition Regulation Supplement Procedures, Guidance, and Information 206.302-1(d), Sources Sought Notice M67854-24-I-3015 was posted to SAM.gov on 7 August 2024. The notice informed industry of PM GWS’ intent to award a sole-source, SeaPort-NxG task order to Systecon and allowed 15 days for responsible SeaPort-NxG schedule holders to respond to the notice. The Government received one response to the notice; however, the response only expressed interest and did not include the required capability statement.
7. Actions to Remove Barriers to Fair Opportunity
For the reasons set forth in paragraphs 4 and 6, PM GWS has no plans at this time to compete future contracts for the types of services covered by this justification. The Government will continue to conduct regular market research to determine if additional sources are available to provide the required services. If another potential source emerges, PM GWS will assess whether competition for future requirements is feasible. Any future actions will be reviewed by PM GWS to offer competition to the greatest extent possible.
