Source Selection Information -- See FAR 2.101 and 3.104.

U.S. Department of Justice

Office of the Inspector General

LIMITED SOURCE JUSTIFICATION & APPROVALS

SIMPLIFIED ACQUISITION EXCEEDING $250,000

JUSTIFICATION

1. Contracting Activity. Department of Justice, Office of the Inspector General

2. Description of the Action being Approved. New contract with Axon Enterprise, Inc., DUNS 832176382

3. Description of the Supplies or Services and Estimated Dollar Value. 120 Axon Body Worn 3 Cameras and associated hardware, 20 docking stations and associated hardware, mounting hardware for cameras, software licenses, and warranties. Delivery required no later than October 1, 2021. Estimated dollar value is $608,113

4. Authority Permitting other than Full and Open Competition. Section 4202 of the Clinger- Cohen Act of 1996.

5. Proposed Contractor’s Unique Qualifications or Nature of the Acquisition that Requires Use of the Authority Cited in Paragraph 4

5A. The supplies or services required are available from only one responsible source and no other type of supplies or services will satisfy agency requirements. The unique or highly specialized qualities are:

Body-Worn Camera(s) (BWC’s) are audio and video recording devices worn by law enforcement officers as part of their uniform to document what they see and hear as they perform their duties. DOJ/OIG requires the ability to ingest, manage and share BWC video captured during law enforcement operations. DOJ/OIG has a strict requirement for BWC video ingest to a FedRAMP JAB Provisional Authority to Operate P-ATO evidence collection system for BWC video/audio evidence. Digital Evidence Management System/Software/Solution(s) (DEMS) Bundle is software used to store, manage, secure, share, redact and protect digital evidence, most typically in the form of video, photo, and audio records. DOJ/OIG requires a DEMS in the form of Software as a Service (SaaS) which is hosted in a vendor provided cloud environment. The SaaS solution must be currently FedRAMP JAB P-ATO Authorized with an Authority to Operate (ATO) rated for impact level moderate. The Axon Software as a Service (SaaS) allows for secure management, access and sharing of digital evidence. Axon Evidence is the only software that includes FedRAMP Authorized solutions that allow for Citizen Digital content request/ingest and AI powered Redaction. Axon Evidence can also store and support various forms of third-party data and can ingest evidence collected from the mobile phone application, Axon Capture. Lastly, Axon Evidence allows for secure case sharing with current Axon

Evidence partner agencies as well as the Executive Office of United States Attorneys (EOUSA).

DOJ-EOUSA has standardized on Axon Evidence for their BWC DEMS.

6. Efforts Made to Ensure that Offers will be Solicited from as Many Potential Sources as is Practicable For the reasons stated in paragraphs 5, 8, 9, and 10, soliciting only one source is the only practicable alternative.

7. Fair and Reasonable Cost. The anticipated cost to the Government is fair and reasonable.

8. Market Research. Extensive market research has been done over the last year and no other company meets DOJ/OIG requirements. Internet research consisted of reviewing DOJ mandates, specifically, DOJ Procurement Guidance Document 15-03, Security of Information, and Information Systems (https://www.justice.gov/jmd/page/file/964941/download) that states Contractor shall comply with all security requirements, including but not limited to the regulations and guidance found in Federal Risk and Authorization Management Program (FedRAMP). At this time, Axon's Evidence.com service is the only known vendor to meet these requirements. A yearly survey will be done of the market to ensure that if new products are not missed and that if there are new products they will be fairly evaluated and will be reviewed.

9. Other facts. The Federal Risk and Authorization Management Program (FedRAMP) is a government program managed by the General Services Administration. It was designed to provide a standardized system for assessing, authorizing and continuously monitoring cloud products and services. Interested offerors must provide a Cloud Service solution that meet the FedRAMP requirements in order to be considered for this requirement. DOJ/OIG requires the use of a FedRAMP certified vendor to capture and maintain Body Worn Camera video and associated evidence. Delivery requested to 1401 S Clark St, Arlington, VA 22202

10. Listing of Sources, if Any, that Expressed an Interest in the Acquisition.

a) Visual Labs – Offered a smartphone mobile BWC application based Digital Collection and Management service. Their cloud service is not FedRAMP certified.

11. Actions to remove barriers for any subsequent acquisition for the same supplies or services.

For the reasons set forth in paragraph 5, there are no plans at this time to compete future contracts for the types of supplies covered by this Limited Source Justification. If another potential source emerges, an assessment will be made at that time to determine whether future competition is feasible.

STAND ALONE PAGE

Answer the applicable question(s):

1. Explain why the price is fair and reasonable. Answer is always required. The vendor is the only BWC and Digital Evidence Management System that is FedRAMP moderate certified. DOJ/OIG is required to use FedRAMP certified products. The vendor quote is similar to other non-FedRAMP certified vendors. The price is fair and reasonable.
