About this file
This is a Statement of Work (SOW) from the United States Patent and Trademark Office for procuring a Commercial-Off-The-Shelf (COTS) Optical Character Recognition (OCR) capability to support the Docket and Application Viewer (DAV) Relevant Prior Art (RPA) Service. The primary purpose is to secure OCR software licenses and technical support for extracting text from PDF and TIFF image documents within the Patent Exam Center product, which enables patent examiners to manage applications and make patentability determinations.
The scope specifies three identical contract line item number (CLIN) groups (0001-0005, 1001-1005, and 2001-2005) for Tungsten Automation products: Western OCR Server OEM v22 for Linux, Recognition Add-on Server OEM v22 for Linux, Asian Add-on Server OEM v22 for Linux, OmniPage Capture OCR Volume licensing for 5 million pages, and an Incident Support Program offering 10 incidents with 20 hours and bug fixes. Each CLIN group contains one unit of each product. The contractor must provide direct access to technical support teams for initial installation, configuration, and ongoing technical assistance, including installation instructions, minimum system requirements, on-call support, knowledge base resources, and configuration guidance. The Department of Commerce will conduct Supply Chain Risk Management assessments, and contractors must agree to potential audits of supply chain risk processes. Failure to resolve identified supply chain risks may result in contract termination.

3.2. The Office of the Chief Information Officer (OCIO). The Chief Information Officer (CIO) is the principal advisor to the Undersecretary of Commerce for intellectual property and director of the United States Patent and Trademark Office on the application and transformation of information technology (IT) for the USPTO’s business.
The organization leads IT strategy and management in support of the agency’s mission, including big data, cybersecurity, cloud computing, and emerging technology.
3.3. Business Product Delivery Office (BPDO). The BPDO is a product-centric, DevSecOps organization that delivers business value to customers via software, from initial design to the deployment and ongoing operation.
3.4. Patent Product Delivery Division (PPDD). The PPDD is a product-centric DevSecOps organization that delivers business value to Patents customers via software, from initial design to the deployment and ongoing operation.
3.4.1. Patent Product Delivery Branch 3 (PPDB3). The PPDB3 provides end-to-end business product delivery (i.e., Development, Security, and Operations), including product management, in support of the Patent Exam Center (PEC) product of the Patent Product Line (PPL).
3.5. PPL PEC. The PEC Product allows users to manage patent applications, search prior art, and make patentability determinations.
3.5.1. Docket and Application Viewer (DAV). A component of PEC, the DAV provides examination tools for patent examiners to track and manage the cases in their docket and view documents in image and text format.
3.5.2. Relevant Prior Art (RPA). The new RPA service for DAV will increase patent examination quality and efficiency by automating the import of relevant prior art
Form # USPTO-OP-020 (08/2020) Page 2 of 4 and other pertinent information and automatically map citations to the documents in a patent application.
3.5.2.1. The documents may take the form of prior domestic or foreign patent documents, or non-patent literature (NPL). The documents are submitted to USPTO with a list of citations recorded on a form PTO/SB/08a (07-09) Information Disclosure Statement (IDS) completed by the Applicant.
The IDS is included in the file wrapper of the application for subsequent consideration by a Patent Examiner. In turn, the Patent Examiner will provide a Notice of References Cited (PTO-892) to the patent applicant.
3.5.2.2. For Portable Document Format (PDF) Image or Tag Image File Format (TIFF), the RPA Service shall utilize commercial-off-the-shelf (COTS) OCR products to extract image content to hyper-text markup language (HTML) text, improving quality and accuracy. Figure 1 below provides a high-level view of the RPA process and the role of the required OCR capability.

5. Mitigating Supply Chain Risk
The Department of Commerce (DOC) utilizes a Supply Chain Risk Management (SCRM) Program to identify, assess, and monitor supply chain risks of critical vendors. The Government may use any information, public and non-public, including all-source intelligence for its analysis. The Contractor agrees that the Government may, at its own discretion, perform audits of supply chain risk processes or events consistent with other terms in the contract regarding access to records and audits. An onsite assessment may be

Through the information obtained from a SCRM program, DOC may assess vendors and products through multiple risk lenses such as national security, cybersecurity, compliance, and finance. If supply chain risks are identified and corrective action becomes necessary, mutually agreeable corrective actions will be sought based upon specific identified risks. Failure to resolve any identified risk may result in contract termination.
