GENERAL SERVICES ADMINISTRATION

Public Building Service Great Lakes, Region 5

Acquisition Management Division Justification and Approval for Other than Full and Open Competition

Project Name: Modification PS0008 to recurring services contract 47PF0020D0005 for Operation and Maintenance at the Gerald R. Ford Federal Building in Grand Rapids, MI;

U.S. Federal Building and Courthouse in Kalamazoo, MI; and Charles E. Chamberlain U.S.

Federal Building and U.S. Post Office in Lansing, MI

1. Identification of the agency and contracting activity.

This Justification and Approval (J&A) for Other Than Full and Open Competition is executed by the General Service Administration (GSA) Public Building Services (PBS) Great Lakes Region 5 Acquisition Management Division.

Vendor Name: Multi Air Services Engineers, Corp (MASE) SAM UEI: GJ63QJD2MM3 Cage: 56T11

2. Nature and/or description of the action being approved.

This activity proposes to negotiate a non-competitive award (sole source) for the procurement of emergency bridge Operations and Maintenance services at two contract locations (the U.S. Federal Building and Courthouse in Flint, MI and the Social Security Administration in Saginaw, MI) for a period of 7 months. The anticipated period of performance for the awarded modification is: 08/01/2022 - 02/28/2023.

This modification is required because the current provider of Operation and Maintenance services in Flint and Saginaw informed the Government on 07/01/2022 that they would be unable to continue performing services after 07/31/2022. A solicitation for a competitive follow-on award at the Flint and Saginaw locations is currently in development, with an expected award date of December 1, 2022 and anticipated start date of 03/01/2023.

3. Description of the supplies or services required to meet the agency’s needs (including the estimated value).

The primary contract is to provide Operations and Maintenance services for GSA Region 5 PBS at the U.S. Federal Building and Courthouse in Flint, MI and the Social Security Administration building in Saginaw, MI.

GSA requires these emergency bridge services as the current vendor is unable to perform these essential services after 07/31/2022, and the Government had less then one month to secure O&M services at these locations. An emergency bridge modification to the already-existent O&M services contract 47PF0020D0005 at three nearby locations provides GSA with the most effective and efficient method of contract performance until the follow-on competitive contract is in place.

The estimated value for this acquisition is $152,390.97 for the 7-month period of performance. $134,047.60 will be obligated via Modification PS0008 and the remainder will be obligated in a separate modification, concurrent with the next Option modification for base contract 47PF0020D0005.

4. An identification of the statutory authority permitting other than full and open competition.

The statutory authority permitting other than full and open competition is 41 U.S.C.

3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-2 entitled, “Unusual and Compelling Urgency.”

5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

MASE is uniquely qualified to provide these services to GSA PBS based upon the following: They are currently performing similar services satisfactorily at nearby contract locations and have specific knowledge of the local labor and subcontractor communities.

This vendor has cleared personnel available who can serve as a substitute Flint and Saginaw onsite mechanic until a long-term replacement can be hired and cleared. This vendor has cleared personnel who can access the NCMMS and BAS systems immediately. There is risk of severe system failure within the facility should services be interrupted while waiting for the processing of credentials from another contractor. These systems require continued scheduled preventative maintenance and operations to ensure continued satisfactory performance. Resource-sharing across the contract locations reduces the cost of these emergency services.

The nature of the unusual and compelling urgency is that the Government was provided with just one month’s notice of the current O&M vendor in Flint and Saginaw’s intent to default on the contract and discontinue services after 07/31/2022. O&M services are essential to the safe and efficient operation of these facilities and to supporting the missions of our tenant agencies. Without an onsite O&M vendor, there are risks to essential systems such as HVAC; fire and life safety; potable water; and architectural and structural systems. Therefore, in order to ensure services would be awarded prior to the end of July 2022, GSA needed to add the Flint and Saginaw services to another O&M services contract in the same geographic area.

6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by FAR 5.2 and, if not, which exception under FAR 5.202 applies.

In accordance with FAR 6.305(b), the OFOC will be posted within 30 days after the execution of the modification. GSA considered whether to approach other vendors in the State of Michigan. However, the 30-day timeframe was determined to be too short to compete the requirement.

7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer has determined the cost to the Government to be fair and reasonable. This determination is based on a comparison of current contract pricing, other information made available, and a detailed cost analysis of each element of the proposal.

8. A description of the market research conducted (see FAR Part 10) and the results or a statement of the reason market research was not conducted.

Market research was conducted to identify available sources and to evaluate the availability of the marketplace to meet the requirement for the existing solicitation. Based on the results of market research, the government has determined that no contractors are available to begin services within 30 days, by the current end date of performance. No other contractor possesses personnel with the specific building knowledge or security credentials required to continue performance with this shortened period for execution.

9. Any other facts supporting the use of other than full and open competition.

There are no additional facts to be reported in this section.

10. A listing of any sources that expressed a written interest in the acquisition.

No sources indicated an interest in this acquisition for this shortened performance period.

11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.

Competition is already underway for a follow-on contract, with a planned award during the first quarter of FY2023. The extended period of performance will be established only to provide continued services while the competitive follow-on procurement process is being conducted.

12. CERTIFICATION

The OFOC has been prepared and certified by:

Contracting Officer: I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
