GSA GREAT LAKES REGION
JUSTIFICATION AND APPROVAL FOR OTHER THAN FULL AND OPEN COMPETITION
FOR
ELEVATOR MAINTENANCE SERVICES
JAMES M. ASHLEY & THOMAS W. L. ASHLEY U.S. COURTHOUSE

TOLEDO, OHIO 43604
1. Identification of the agency and contracting activity.
This Justification and Approval (J&A) for Other Than Full and Open Competition is executed by the General Service Administration (GSA) Public Building Services (PBS) Great Lakes Region 5 Acquisition Management Division.
2. Nature and/or description of the action being approved.
This activity proposes to negotiate a non-competitive award (sole source) for the procurement of elevator maintenance services for a period of two months. The anticipated period of performance for the awarded modification is August 1, 2024, to September 30, 2024. This extension period is to ensure that GSA has a means to continue performance of critical services to its facilities between the expiration date of the current IDIQ contract and the award of the follow-on IDIQ award.
3. Description of the supplies or services required to meet the agency’s needs (including the estimated value).
The purpose of the contract is to provide Elevator Maintenance Services for GSA Region 5 PBS at the James M. Ashley & Thomas W. L. Ashley U.S. Courthouse, 1716 Spielbusch Avenue, Toledo, Ohio, 43604.
GSA requires this extended period for the existing IDIQ contract to cover the need for services as there has been delays in construction of the Annex (an adjacent building).
An extension provides GSA with the most effective and efficient method of contract performance until the follow-on IDIQ award is in place.
The estimated value for this acquisition is $1,825.15 per month or $3,650.30 for the 2-month period.
4. An identification of the statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C.
3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-2 entitled, “Unusual and compelling urgency”.
5. A demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.
Schindler Elevator Corporation is uniquely qualified to provide these services to GSA PBS based upon the following: They are currently performing these services satisfactorily and have specific knowledge of the facilities and required services. All contractor personnel have received favorable adjudication of their National Agency Check with Inquiries clearance and a GSA ENT user credential permitting full access to the facility and system. There is risk of severe system failure within the facility should services be interrupted while waiting for the processing of credentials from another contractor. These systems require continued scheduled preventative maintenance and operations.
Furthermore, the Government will realize cost savings for a reduction in procurement costs and other administrative burdens including startup costs (costs contractors build into their price – tools, equipment, recruiting, training, etc.) and phase out costs.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by FAR 5.2 and, if not, which exception under FAR 5.202 applies.
In accordance with FAR 6.305(a), the OFOC will be posted within 14 days after the execution of the modification for 30 days.
7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.
GSA has compared the base award pricing with updated Labor Union Wage Rates and increases in cost to maintenance parts and prepared a Price Reasonableness Memo to assist in the establishment of a fair and reasonable price. Additionally, the two-month period will be awarded at the contractors proposed monthly price, which was determined to be fair and reasonable.
8. Description of the market research conducted
Market research was performed for the current contract. The Government has determined that no other contractors are available to begin services by the current end date of performance. No other contractor possesses personnel with the specific building knowledge or security credentials required to continue performance with this shortened period for execution.
9. Any other facts supporting the use of other than full and open competition.
There are no additional facts to be reported in this section.
10. A listing of any sources that expressed a written interest in the acquisition.
No sources indicated an interest in this acquisition for this shortened performance period.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition if subsequent acquisitions are anticipated.
Preparation is already underway for a follow-on IDIQ Award, with a planned award during FY26, Q1. The extended period of performance will be established only to provide continued services until the warranty period starts and the competitive source selection process is being conducted.
