Justification for an Exception to Fair Opportunity Enterprise Services Office of Acquisition

1401 Constitution Avenue NW Washington, D.C. 20230 new effort would require formal CITRB approval. OCIO is seeking CITRB approval in May 2020 as this is the earliest estimated date that OCIO will be able to accomplish all requirements for CITRB approval. As the current task order is set to expire in March 2020 this has led to a possible gap in service as the requirement can not move forward without CITRB approval. The 6-month extension that is being requested would allow sufficient time to obtain all required approvals, solicit, award and allow for a needed transition period.

5. Determination by the ordering activity contracting officer that the anticipated cost to the

Government will be fair and reasonable.

The Contracting Officer performed price analysis in accordance with FAR 15.404-l(b) to determine that the cost to the Government was fair and reasonable when the existing order was awarded. The existing task order was issued to Patriot as a logical follow-on against the IDIQ contract under the CIO-SP3 GWAC, which has ceiling rates previously determined as fair and reasonable at time of award. In addition, the Contracting Officer used historical data of prices paid for work performed under the previous order to verify that pricing negotiated for the logical follow-on was fair and reasonable. The pricing negotiated for this 6-month extension will also be established at the existing order pricing level.

6. Any other facts supporting the justification

All supporting facts have been documented herein.

7. Actions, if any, the agency may take to remove or overcome any barriers that led to the exception to fair opportunity before any subsequent acquisition for the supplies or services is made.

The agency has performed market research and is in the process of having the acquisition plan approved and signed for award of a new competitive procurement for OESS support services scheduled for award by the end of 3 rd quarter of FY20.

8. Technical/Requirements Representative Certification

I certify that this requirement constitutes the Government's minimum needs and the supporting data provided herein is accurate and complete to the best of my knowledge and belief.
