About this file

This is a sample Payment and Performance Bond document for the County of San Mateo, California, designed for use with Job Order Contracts (JOC) in general construction. The document provides template forms for both payment bonds and performance bonds that contractors must submit before commencing work. The payment bond secures claims from laborers, material suppliers, and other claimants under California Civil Code Sections 9550-9566 and 9100-9364, while the performance bond guarantees faithful execution of all contract terms, conditions, and authorized modifications. Both bonds are executed jointly and severally by the principal contractor and a corporate surety, with notarized acknowledgments and power of attorney documentation required for the surety. The bonds include provisions waiving notice to the surety of contract extensions, changes, alterations, or modifications, and stipulate that changes not exceeding 20 percent of the original contract price do not void the obligation. Additionally, the document includes a guarantee form for subcontractor work, requiring repair or replacement of defective workmanship or materials within a specified period, with authorization for the owner to perform corrective work at the contractor's expense if compliance is not achieved within seven calendar days of written notice.

The bond amounts and specific contract details are left blank in this template for completion upon contract award. The payment bond covers all amounts due to claimants and provides for reasonable attorney's fees to the prevailing party in any suit, while the performance bond amount typically corresponds to the contract value. The document emphasizes that correspondence regarding bonds should be directed to the surety at a specified address and that all bonds remain in full force and effect throughout the original contract term and any extensions granted by the county. These sample forms establish the financial security and performance assurance mechanisms required for general construction contractors participating in San Mateo County's Job Order Contract program, protecting both the county and construction industry workers and suppliers.
