About this file

This document is a Sole Source/Brand Name Justification under the Simplified Acquisition Threshold (SAT) for the procurement of a Remote Firing Device - Full Kit with 2 transmitters and 10 receivers from Sericore Industries. The justification explains that the Sericore system is a joint program of record for U.S. military Explosive Ordnance Disposal (EOD) units and meets all required military standards, making it the only available brand that can meet the agency's needs. The agency intends to award a firm-fixed price purchase order for one kit, with an estimated total price of $26,000 and a desired delivery date of September 1, 2024. The procurement will be a small business set-aside under NAICS code 334519.

NSWCCD Sole Source/Brand Name Justification Under SAT Rev 4 Template Page 1 of 4

Effective February 2024

MEMORANDUM FOR FILE

FROM: Jarret Garibaldi, Dynamic Measurements and Test Branch

CODE: 663

TO: Code 02 SUBJECT: Sole Source/Brand Name Justification / Limited Source Justification for Use of Other than Full &

Open Competition for an Acquisition under the Simplified Acquisition Threshold (SAT)

I. BACKGROUND

1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available.

2. FAR 8.405-6(b)(1) states Brand name specifications shall not be used unless the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.

3. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.

4. This memorandum is derived from Enclosure 3, Department of Navy Simplified Acquisition Procedures Guide (April 2018) and is only applicable to acquisitions under the SAT.

II. DESCRIPTION OF ITEM OR SERVICE (include manufacture/sole source name and address)

Remote Firing Device – Full Kit with 2 transmitters and 10 receivers (Qty: 1) from Sericore Industries to be used in place of the current wired firing system traditionally used during full ship shock trials to detonate explosive charges at sea. Desired delivery date is 1 September 2024; current manufacturer lead time is 60-90 days.

MANUFACTURER: Sericore Industries ADDRESS: 306 Crain Hwy South, Glen Burnie, MD 21061 PHONE:

POC: Casey Hardiman

ESTIMATED TOTAL PRICE INCLUDING OPTIONS: $26,000

III. BASIS FOR DETERMINATION FOR USE OF OTHER THAN FULL & OPEN COMPETITION

The remote firing device (full kit) is available through GSA and Ideal Blasting Supply, however, the current price quote direct from the manufacturer is cheaper than the listed third-party retailers.

☒ A. BRAND NAME:

NSWCCD Sole Source/Brand Name Justification Under SAT Rev 4 Template Page 2 of 4

Item required must be a brand name product, or feature of a product, particular to one manufacturer.

The Sericore Industries remote firing system is a joint program of record for the joint Explosive Ordnance Disposal (EOD) units of the U.S. military and the primary remote firing system for many federal and local law enforcement agencies beginning in 2015. This system has met all the required military standards required by the Weapons Systems Explosives Safety Review Board (WSESRB), Naval Ordnance Safety and Security Activity (NOSSA), and meets the operational requirements for code 663 to implement into current standard operating procedures (SOPs).

☐ 1. Restrictive Rights: The source has established proprietary rights, limited rights in data, patent rights, copyrights, or secret processes in the item or service required.

☐ 2. Exclusive Licensing Agreements: The item or service is only available from the Original Equipment Manufacturer (OEM).

☒ 3. Other Reasons:

In addition to meeting the necessary safety and reliability standards of the Department of Defense it offers the most intuitive and reliable remote firing capability currently available in the explosive operations community that can be implemented with our current detonators at reasonable market value. The manufacturer of our current firing system (FS-43) does not produce a wireless firing system. The Dyno Nobel Digishot initiation system was another option but would require specific Dyno Nobel detonators that do not meet the pressure tested requirements for underwater detonations (UNDEX). The Sericore Industries system meets agency safety and performance requirements while also working in conjunction with current previously purchased detonators making this system the most cost effective.

☐ B. SOLE SOURCE (select all that apply)
