About this file

This document contains a justification and approval for a sole source contract and a related solicitation for circuit card assemblies. The Naval Sea Systems Command, Naval Surface Warfare Center, Port Hueneme Division intends to award a firm-fixed-price contract on a brand name basis to Abaco Systems for 420 circuit card assemblies to be used in launch control computers that control missile launchers. The justification cites 10 U.S.C. 2304(c)(1) regarding brand name descriptions and details that qualifying alternate sources would duplicate qualification costs of over $2 million. The related solicitation seeks quotes by June 17, 2020 for the 420 circuit card assemblies from Abaco Systems, evaluates quotes based on lowest price technically acceptable, and references various Federal Acquisition Regulation clauses.

JUSTIFICATION AND APPROVAL

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Port

Hueneme Division, (NSWC PHD).

2. Description of the Action Being Approved

NSWC PHD intends to award a new Firm-Fixed-Price contract on

Brand Name basis to Abaco Systems for 420 Circuit Card Assemblies

(CCA) (400 CCA part number (p/n) PMC613FXPSC and 20 CCA p/n

PPC11AP-2ADB).

3. Description of Supplies/Services

NSWC PHD Air Dominance Department (Code A107) requires the CCAs provided by Abaco Systems. The CCAs, in aggregate, are referred to as the Launch Control Computer (LCC). The LCC is located in the Virtual Machine Environment (VME)’s master slot, and hosts the MK 41 Vertical Launching System (VLS) Launch Control Computer

Program (LCCP), which is part of the Launch Control Unit (LCU).

The LCC is used to host the LCCP in the LCU. The MK 41 VLS is a surface ship combatant missile launcher that stores and launches a variety of missile types. The LCU controls the Launch

Sequencer (LSEQ) in the launchers.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.

The total estimated value of the requirement is $907,664.00 and is composed of the following funding sources reflected in Table 1 below:

Table 1

Fund Type Year: FY20 Total Contract

SCN $907,664.00 $907,664.00

4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C. 2304 (c) (1) as implemented by paragraph 6.302-1(a)(2) of the Federal Acquisition Regulation (FAR); An acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer

5. Rationale Justifying Use Of Cited Statutory Authority

Currently, the Abaco System CCAs p/n PMC613FXPSC and PPC11AP-2ADB

CCAs are used on the LCU’s to support MK 41 VLS. An attempt to identify and qualify alternate parts for the manufacturing of VLS equipment that will meet the requirements will cause a substantial duplication of cost to the Government that is not expected to be recovered through competition. Specifically, the

Navy would incur a non-recurring cost of $2,000,000.00 in order to identify and qualify alternate sources with the capability to produce the required equipment. The $2,000,000.00 estimate derives from the Baseline VII Tech Refresh efforts from 2011-2016 which included taking steps to ensure that any new sources are capable of producing a product that meets the established performance requirements. This includes the costs for the

Government to conduct First Article Tests, Confidence and

Functional testing for form, fit and function. Additionally, the software program would have to be modified, and Shock and

Vibration testing would need to be performed. If an alternate part is determined to be qualified, then additional resources would be required as all applicable documentations will need to be updated through Engineering Change Process (ECP) to introduce the new alternate part. Without the required Abaco System CCAs, the Government cannot have a functional LCU, which will degrade the state of the system, and directly impact the fleet’s capability to launch missiles.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

Sources Sought was posted on Beta.SAM from 08 May through 17 May

2020. Two responses were received, from Abaco Systems, and Omega

Business Systems. Both are capable of providing the required material.

7. Determination Of Fair And Reasonable Price

The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by this J&A is fair and reasonable.

8. Actions To Remove Barriers To Future Competition

For the reasons set forth in Paragraph 5, NSWC PHD has no plans at this time to compete future contracts for the types of supplies covered by this document. If any potential sources emerge, the Government will assess whether competition for future requirements is feasible.
