SUBJECT: LIMITED SOURCES JUSTIFICATION (LSJ)
REFERENCE: Noncompetitive Increase in Scope to BPA No. NRC-HQ-17-A-0007, BPA Call No. 31310018F0015 (End User Computing)
1. Nature and/or description of the action being approved.
This is a request to modify Blanket Purchase Agreement (BPA) No. NRC-HQ-17-A- 0007, BPA Call No. 31310018F0015 to add services for unexpected work in the Help Desk Service Deskside support for each of the Regions and technical training center (TTC) and increase the maximum ceiling of the BPA Call to accommodate for the addition of those services.
a. Acquisition objectives.
The U.S. Nuclear Regulatory Commission (NRC), Office of the Chief Information Officer (OCIO) is requesting a noncompetitive increase to the scope and ceiling value of Blanket Purchase Agreement (BPA) No. BPA NRC-HQ-17-A-0007, BPA Call No. 31310018F0015 with Leidos Innovation Corporation (Leidos) for End User Computing Services (EUC). The EUC BPA Call for the regional deskside helpdesk support CLIN is firm-fixed price. There are some activities that are unexpected and happen outside the hours of operation that cannot be reasonably predicted with any reasonable degree of certainty but must be resolved in order for the NRC to support its mission. The additional support may include, but is not limited to the following:
Power outage in the computer room.
Moving IT systems during facilities work, such as replacing carpets or painting.
System patching or application upgrades that must be done outside of standard operating hours because the systems must be shut down.
Emergency Regional (RISE) site visits due to IT asset issue(s).
Planned or unplanned system outages.
Incident response which require extended hours of support.
COOP emergencies/exercises (e.g. Eagle Horizon)
b. Project Background
The NRC recently changed the way it provides information technology services to its users. Previously, the agency had one IT services contractor under the Information Technology Infrastructure Support Services (ITISS) contract. However, in June 2017, the NRC awarded several GSA Federal Supply Schedule BPAs for the NRC's GLobal INfrastructure and Development Acquisition (GLINDA) multiple-award acquisition to replace the services provided under the NRC’s IDIQ Contract No.
NRC-33-11-325 for ITISS with NTT DATA Services Federal Government, Inc.
In April 2018, the NRC awarded the EUC BPA Call to Leidos. On June 4, 2018, the NRC began the transition of EUC-related requirements from the ITISS contract to the EUC BPA Call. During transition, the NRC discovered a gap in services being transitioned from the ITISS contract to GLINDA EUC BPA Call. The gap was that in the ITISS contract there were labor hours available to handle all of the unexpected work that needed to be accomplished in the regions and TTC. NRC EUC BPA call contract award had a scope that included the regional deskside helpdesk support, but not any unexpected work. The EUC BPA Call is the most appropriate mechanism under which to procure services to include the additional unexpected work since the contractor is already on site performing the same scope of work during normal business hours under the firm fixed price CLIN.

2. Description of the supplies or services required to meet the agency’s needs (including the estimated value).
The Contractor shall provide services in the regional offices and the TTC related to unplanned or unexpected work that needs to happen outside of the normal hours of operations. The activities include but are not limited to:
Power outage in the computer room.

System patching or application upgrades that must be done outside of standard operating hours because the systems must be shut down.

4. Description of the proposed contractor(s) unique qualifications to provide the required supply or service.
The Contractor for the EUC BPA Call is responsible for the incident operations (helpdesk services and desk side support) at each of the regional offices and TTC. These activities include installing, connecting, configuring, upgrading, troubleshooting, diagnosing, repair and replacement of endpoint computer hardware and software. There is also a small percentage of server and network infrastructure that is currently in place at the regional offices and TTC where the Contractor needs to be physically present to provide technical assistance to the infrastructure. These services are currently provided under the Firm Fixed Price (FFP) CLIN during normal business hours by the Contractor.
Similar services may be needed outside of normal hours of operation due to unexpected activity. It is logical that the same Contractor provides these services when needed outside of normal business hours. The Contractor is already familiar with all of the infrastructure and other equipment in the office. They are also familiar with each of the individual regional staff, processes, and procedures. The unexpected work cannot be predicted so NRC is adding Labor Hour CLINs to cover the unpredictable work that may occur outside of normal business hours at the regional offices and TTC.

6. Description of the efforts made by the Contracting Officer (CO) to determine that the cost/price of the contract/order is fair and reasonable consistent with FAR 8.404(d) or 15.406-2.
This additional work will utilize existing labor categories and associated fixed hourly rates in the contractor’s GLINDA BPA. These labor rates were determined to be fair and reasonable at BPA award. In addition, the CO will ask the COR to evaluate the proposed labor category mix and associated hours and will negotiate any changes to that mix to ensure that the price for the modification to the EUC BPA Call is deemed to be fair and reasonable.
7. Description of the market research conducted (see FAR Part 10) and the results, or a statement of the reasons market research was not conducted.
Based on the COR’s technical knowledge of the current requirements and necessary capabilities required to support the IT services listed in this justification, there are no known companies that have the ability to quickly transition these requirements in a short period without significant adverse impacts to the NRC’s IT operations.
8. Any other facts supporting the justification.
Without this modification to add coverage for unexpected work at the Regions and TTC, the NRC may experience a lapse in service. This is unacceptable as maintaining systems in proper working order even outside of normal operating hours is critical to the success of the NRC mission.
Additionally, NRC cannot use in-house resources to provide this support because using government personnel to replace contractor personnel in the execution of the wide range of technical responsibilities and duties for the potential unexpected work that may come up is not realistic or feasible at this time. In-house capabilities are not available; current government personnel do not possess the technical expertise to perform the required services.

10. If applicable, describe the actions the agency may take to remove or overcome any barriers that led to the restricted consideration before any subsequent acquisition for the supplies or services is made.
The Acquisition Management Division will closely scrutinize any subsequent acquisition for the required services and will ensure that any restrictions to competition are adequately justified and documented.
