About this file

This is a Notice of Intent to Sole Source, a presolicitation notice issued by the 10th Contracting Squadron at the US Air Force Academy (USAFA) in Colorado Springs, Colorado. USAFA intends to award a sole source commercial contract to BioSpherix, LLC, a company located in Parish, New York, for the procurement of laboratory equipment. The contracting authority is 10 USC 2304(c)(1), citing only one responsible source as justification for the non-competitive award. The NAICS code is 334516 and the PSC is 6640; the size standard is 1,000 employees. The requirement is valued below the Simplified Acquisition Threshold and will be awarded as a firm-fixed-price purchase order on or before September 30, 2026, subject to fund availability.

The requirement calls for two units of the OxyCycler C42 Dynamic/Pre-programmable O2/CO2 Controller & Single 2-Shelf C-Chamber (Part Number CAT-C421C274), upgradeable to add a second independent chamber. USAFA's Department of Biology requires this specialized equipment to precisely control atmospheric gas concentrations (oxygen, carbon dioxide, and nitrogen) for studying hypoxia and hyperoxia effects on cadet researchers. The market survey determined BioSpherix is the sole manufacturer capable of meeting requirements due to proprietary technology, integrated bi-directional closed-loop gas infusion control, and pre-programmable cycle creation not available from competitors. Custom engineering alternatives would introduce unacceptable technical risk, integration errors, and delays preventing fiscal year completion. A solicitation will not be posted. All responsible sources may submit capability statements demonstrating clear and convincing evidence that competition would benefit the Government. Responses and questions must be submitted to marissa.morris.4@us.af.mil and danielle.hyde.2@us.af.mil no later than 10:00 AM MDT on September 17, 2026. Contractors must maintain current System for Award Management (SAM) registration.

NOTICE OF INTENT TO SOLE SOURCE

FY26 USAFA DFBI BioSpherix OxyCycler & C-Chamber System

This is a special notice prepared in accordance with (IAW) the Revolutionary Federal

Acquisition Regulation (FAR) Overhaul (hereinafter referred to as RFO) 5.101 –

Presolicitation Notice. The contracting office for this notice is the 10th Contracting

Squadron, USAF Academy, CO 80840.

The US Air Force Academy (USAFA) intends to award a sole source commercial contract using simplified acquisition procedures IAW RFO Part 12 to BioSpherix, LLC, a company out of Parish, New York. The authority for this non-competitive award is 10 USC

2304(c)(1), only one responsible source. The NAICS code for this requirement is 334516 and the PSC is 6640. The size standard as defined by the U.S. Small Business

Administration is 1,000 employees. This notice incorporates provisions and clauses that are in effect through the RFO effective 1 February 2026. The Government has deemed

BioSpherix, LLC. (BioSpherix) to be a responsible contractor with respect to performance.

Only one responsible source and no other item will satisfy the USAFA requirement.

A comprehensive market survey was conducted to identify potential vendors for the required equipment. This research included a detailed search of the General Services

Administration (GSA) Advantage! website and other government supply sources. No mandatory supply sources can provide this specialized laboratory setup. The market research concluded that BioSpherix is the only vendor capable of meeting the government's requirements for the following reasons:

❖ Proprietary Technology and Interoperability: The USAFA Department of

Biology (DFBI) requires an integrated laboratory chamber system that can precisely control atmospheric gas concentrations (O2, CO2, and N2) dynamically to study hypoxia and hyperoxia effects. BioSpherix, LLC is the sole manufacturer of the proprietary OxyCycler C42 Dynamic/Pre-programmable O2/CO2 Controller system and the compatible single 2-shelf incubator sub-chamber (C-Chamber). This system possesses unique, integrated bi-directional closed-loop gas infusion control and pre-programmable cycle/profile creation that is not offered by standard laboratory incubators or custom engineering integrators without substantial cost duplication and unacceptable schedule delays.

❖ Avoidance of Substantial Duplication of Costs and Delays: Procuring from another source would require a custom-engineered development program (as indicated in other market responses) which introduces high technical risk, integration errors, and potential delays that would prevent fulfillment before the end of the fiscal year. Purchasing the BioSpherix C-Chamber system allows immediate, out-of-the-box integration into third-party laboratory incubators already owned by USAFA.

❖ Operational Efficiency: The OxyCycler C42 provides cadet researchers with an unparalleled, highly precise platform for hands-on experiential learning in aerospace physiology and human performance. It supports an average of 2–3 cadets per semester, directly addressing a critical capability gap. Without this specific instrument, DFBI will be unable to execute controlled atmospheric gas exposure profiles safely and repeatably.

This request is issued for the USAFA Department of Biology (DFBI). Anticipated award on or before 30 September 2026 (subject to availability of funds) as a firm-fixed-price purchase order.

A SOLICITATION WILL NOT BE POSTED. Based on market research conducted, the

Government intends to proceed with this sole source action. This synopsis is for informational purposes only and does not constitute a solicitation for bids or proposals.

Approval will not be posted as this requirement is valued below the Simplified Acquisition

Threshold (SAT).

All responsible sources may submit a capability statement. Interested concerns must show clear and convincing evidence that competition of this requirement would be advantageous to the Government. Oral communications are not acceptable in response to this notice. A determination by the Government not to compete this proposed requirement is solely within the discretion of the Government.

Responses and questions regarding this notice of intent to sole source shall be submitted to marissa.morris.4@us.af.mil AND danielle.hyde.2@us.af.mil no later than 10:00 AM, MDT on 17 September 2026. Responses received after this will be considered late IAW RFO

52.212-1(c) and will not be answered. Contractors must have a current registration with the

System for Award Management (SAM) at http://sam.gov/. The Government bears no legal liability for any costs incurred by responding to this notice.
