About this file

This is a Notice of Intent to Negotiate a Sole-Source Contract issued by the U.S. Department of Commerce, National Oceanic and Atmospheric Administration (NOAA), through its Acquisition and Grants Office and Office of Marine and Aviation Operation.

NOAA intends to award a sole-source contract to Lockheed Martin Corporation, Rotary and Mission Systems (Lockheed Martin RMS) for L382J Aircrew Training Services. The requirement encompasses aircraft-specific training for NOAA pilots and loadmasters to operate the agency's forthcoming fleet of C-130J aircraft. Training will consist of ground school academic classes and simulation sessions providing ratings, endorsements, and certificates required for NOAA personnel to safely operate the C-130J. All courses must meet Federal Aviation Administration curriculum and syllabus requirements under 14 CFR Part 141 or 142. The sole-source justification is based on Lockheed Martin's proprietary ownership of the C-130J aircraft platform, including all copyright, licenses, schematics, and software coding. The NAICS code for this requirement is 611512 – Flight Training with a $34 million average annual receipts size standard. The procurement authority is 41 U.S.C. 1901 as implemented by FAR Part 12. Although this is a sole-source notification, interested parties may submit capability statements demonstrating their ability to meet all requirements. Capability statements must be submitted in writing with sufficient detail to Jennifer Peters, Contract Specialist, at Jennifer.peters@noaa.gov by 2:00 PM ET on Wednesday, June 10, 2026. The Government retains discretion to conduct a competitive procurement based on responses received.

The authority permitting other than full and open competition is 41 U.S.C. 1901 as implemented by the Federal Acquisition Regulation (FAR) Part 12 and permitted under 6.103-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

Courses conducted shall meet Federal Aviation Administration (FAA) curriculum and syllabus requirements under 14 CFR Part 141 or 142. Given the C- 130J aircraft platform is proprietary to the Original Equipment Manufacturer (OEM), Lockheed Martin (LM), the necessary training to operate such aircraft can only be provided through the sole source provider (LM). In addition, LM holds all copyright, licenses, schematics, and software coding ownership tied to these aircraft.

This notice does not constitute a solicitation, Request for Proposal (RFP), Request for Quotation (RFQ), or an Invitation for Bid (IFB) and it does not restrict the Government in any way regarding its ultimate acquisition approach. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to provide the required services. The capability statement and any other information furnished must be in writing and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements.
