About this file

This document is a Notice of Intent to Negotiate a Sole-Source Contract issued by the U.S. Department of Commerce's National Oceanic and Atmospheric Administration (NOAA). NOAA intends to award a sole-source contract to L3 Harris Technologies for AN/APY-11 Multi-Mode Radar (MMR) Systems and components for NOAA's upcoming C-130J aircraft fleet. The radar systems will include multiple components such as X-Band Antenna, Front End Receiver, Transmitter, Drive Amplifier Unit, Inertial Measurement Unit, and Lightweight Radar Processor, among other associated equipment.

The sole-source justification is based on L3 Harris being the only provider capable of supplying the specialized radar system, holding all copyrights, licenses, schematics, and software coding. ELTA Systems, Ltd. has authorized L3 Harris as the sole distributor of the equipment. Interested parties can submit a capability statement to the Contract Specialist, Jennifer Peters, via email by 2:00 PM ET on Friday, April 18, 2025, to potentially be considered for the requirement. The contract falls under NAICS code 334511 with a size standard of 1,350 employees, and NOAA reserves the right to determine whether to conduct a competitive procurement based on received responses.

NOTICE OF INTENT TO NEGOTIATE A SOLE-SOURCE CONTRACT

The U.S. Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Acquisition and Grants Office (AGO), Eastern Acquisition Division (EAD) and the Office of Marine and Aviation Operation (OMAO), Platform and Infrastructure Acquisition Division (PIAD) will solicit and award the requirement herein on a sole source basis to L3 Harris Technologies for AN/APY-11 Multi-Mode Radar (MMR) Systems and components to operate on NOAA’s forthcoming fleet of C-130J aircraft. The authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements, under FAR 6.302-1(a), When the supplies or services required by the agency are available from only one responsible source.

Each AN/APY-11 System is expected to be comprised of the following components:

X-Band Antenna configured for the C-130J Lower Fuselage Antenna Adapter Plate Front End Receiver (X-Band) X-Band Receiver Cold Plate Assembly Transmitter Transmitter Tray Drive Amplifier Unit (DAU) DAU Cold Plate Assembly Inertial Measurement Unit (IMU) Lightweight Radar Processor (LRP) LRP Tray Associated components necessary to operate and display the radar data

Only one source is capable of providing the required equipment herein for several reasons. The AN/APY-11 MMR was specially developed, designed, and outfitted to dive deeper into the structure of the storm, variances within, as well as navigate directly through such weather. L3 Harris holds all copyright, licenses, schematics, and software coding tied to these MMR Systems (currently installed on both of NOAA’s WP-3D Hurricane Hunter aircraft). Furthermore, the sole Original Equipment Manufacturer (OEM) (ELTA Systems, Ltd) has authorized L3 Harris as the sole source distruster of this equipment. Continuity of radar functionality and capabilities is vital to a seamless integration from the current WP-3D aircraft platform to the C-130J platform.

The North American Industry Classification System Code (NAICS) is 334511- Search, Detection, Navigation, Guidance, Aeronautical, and Nautical System and Instrument Manufacturing with a corresponding size standard of 1,350 employees. This notice does not constitute a solicitation, Request for Proposal (RFP), Request for Quotation (RFQ), or an Invitation for Bid (IFB) and it does not restrict the Government in any way regarding its ultimate acquisition approach. However, if any other interested party believes that it can meet the requirements, it may submit a statement of capabilities, which if timely received, will be considered by NOAA. A determination by the Government not to compete this proposed requirement based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future. Evidence must be provided of ability to provide the required services. The capability statement and any other information furnished must be in writing and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements. Capability statements and related materials must be e-mailed to the Contract Specialist, Jennifer Peters, at Jennifer.peters@noaa.gov by 2:00 PM ET on Friday, April 18, 2025.
