NOTICE OF INTENT TO ISSUE SOLE SOURCE AWARD

The Department of Veterans Affairs (VA) Strategic Acquisition Center – Frederick (SAC- F), on behalf of the Records Center and Vault (RCV), located in Neosho, MO intends to negotiate with Empire District Electric Company (a large business) on a sole source basis, under the authority of Federal Acquisition Regulation FAR 13.501(a)(1)(ii). The statutory authority permitting other than full and open competition is 41 USC 1901(a)(1) as implemented by FAR 13.106(b)(1) to procure electric utility services for the RCV.

Empire District Electric Company is a power company providing electric utilities to customers in the Neosho/Newton County area of Missouri. Empire District Electric Company is the current provider, and the only provider authorized to provide power to the site, and they are already providing services to the RCV in Neosho, MO.

Utility services are highly regulated in Missouri, and there is only one available source to meet the agency’s needs: Empire District Electric Company. Empire District Electric Company is the only electric provider that services customers in the Neosho/Newton County area of Missouri. Missouri is not a de-regulated state for utilities. Each utility has a service territory. The Neosho/Newton County is within Empire District Electric Company service territory, so therefore the company would be the only option for an electricity provider. This information is from their description of service territory on their tariffs.

The NAICS code is 221122 with a small business size standard of 1,000 employees.

SAC-F anticipates negotiating and awarding a firm-fixed-price purchase order (simplified acquisition) to Empire District Electric Company for this requirement by January 31, 2022.

Interested parties that believe they could satisfy the requirements listed above for SAC- F may clearly and unambiguously identify their capability to do so in writing on or before the response date for this notice. This notice of intent is not a solicitation. Information submitted in response to this notice will be used solely to determine whether competitive procedures could be used for this acquisition.
