CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION DETERMINATION
The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted. FCS Express Site License from De Novo Software is required to enable multi-parametric flow and image cytometry data analyses by current users supported by NINDS Flow and Imaging Core Facility. This project is a continuation of an existing De Novo software license procurement that was purchased under POTS # 21-001704. DNS have no resellers for the requested software services.
In accordance with FAR part 10, the market research was conducted to reach this determination. Specifically, contacted knowledgeable individuals in Government and industry regarding market capabilities to meet requirements, reviewed the results of recent market research undertaken to meet similar or identical requirements. Finally, a review of the GSA Advantage, and previous government acquisitions returned no results that meet all of the requirements. Therefore, DNS is the only known source who is capable of meeting the needs of this requirement.
