NOTICE OF INTENT TO SOLE SOURCE
The US Army, Corps of Engineers, New Orleans District, is issuing this Notice of Intent (NOI) to inform industry contractors of the Government’s intent to negotiate on a noncompetitive basis in accordance with FAR 6.302-1(a) (2) - Only one or a limited number of responsible sources and no other supplies or services will satisfy agency requirements.
The intended Contractor is Chef Menteur Credit Co., LLC., 5550 Newbury St., Ste. B, Baltimore, MD 21209.
The U.S. Army Corps of Engineers, New Orleans District, (Government) seeks to acquire Brackish Marsh (LDNR) credits representing 0.58 Average Annual Habitat Units (AAHUs) to mitigate for impacts incurred and reasonably foreseeable impacts from the Morganza to the Gulf of Mexico (MTG), Humble Canal Gate Site Preparation and Initial Levee Preload, Brackish Water Marsh, Terrebonne Parish, Louisiana (Project), within the Louisiana Coastal Zone (CZ).
A mitigation bank must be physically located within the Deltaic Plain which is coextensive with Hydrologic Unit Code (HUC) 08070203, 08070204, 8070205, 08080101, 08080102, 08080103, 08090100, 08090201, 08090202, 08090203, 08090301, and 08090302. The purchase of these credits will fully satisfy the Government’s requirement to mitigate 0.58 AAHU of brackish marsh impacts incurred during work associated with construction of the MTG project. A mitigation bank must meet all of the following qualifications to be eligible to sell credits to satisfy the MTG Project mitigation requirements. For a proposal to be considered responsive and for the Offeror to be considered responsible, the mitigation bank shall:
• be approved by CEMVN and in full compliance with its Mitigation Banking Instrument, its other legal instruments (such as its conservation servitude and its financial assurances), and the standards set forth in 33 CFR Part 332; and
• provide habitat type that matches the habitat type being mitigated; and
• have credits assessed using version 2.0 of the Wetland Value Assessment (WVA) Brackish Marsh Community Model available to compensate for the impacts to the particular habitat to be mitigated; and
• have a duly recorded perpetual conservation servitude/easement; and
Chef Menteur Credit Co., LLC. is the only company who has the necessary mitigation bank credits for the USACE, New Orleans District to purchase. Utilization of a different contractor would create unacceptable delays in fulfilling the agency's requirement because other companies would have to go through the CEMVN, Regulatory Division approval process which is lengthy and timely.
The North American Industry Classification System (NAICS) for this requirement is 523910 – Miscellaneous Intermediation. The Small Business Administration (SBA) size standard for this sector is $47.0 Million.
