About this file
This notice announces the U.S. Agency for International Development's (USAID) Kenya and East Africa Mission's intent to negotiate a non-competitive $15.1 million cost increase to its existing Sustainable, Transformational and Accessible Water Interventions (STAWI) activity contract with DAI Global LLC. The original STAWI contract was competitively awarded on March 31, 2022 to DAI with a period of performance through January 24, 2028. The cost increase is being pursued on a non-competitive basis under the authority of the USAID Acquisition Regulation to support the U.S. government's efforts to address the food security crisis exacerbated by Russia's invasion of Ukraine and the prolonged drought in the Horn of Africa region. The additional funds will enable DAI to provide services such as supporting vulnerable counties in managing scarce water resources, resuming disrupted water services, assisting farmers and pastoralists, and fostering collaboration on building resilience. Responses to the notice must demonstrate how competition would benefit USAID's objectives by July 21, 2023, with any expressions of interest to be considered at the sole discretion of USAID.

Notice of Intent for Other than Full and Open Competition
Solicitation Number: 615-2023-STAWI-01 Notice Type: Special Notice Agency: US Agency for International Development (USAID) Office: USAID/Kenya and East Africa (USAID/KEA) Location: Kenya Notice date: July 21, 2023
USAID/KEA intends to negotiate a non-competitive $15,100,000 Total Estimated Cost Increase to the Sustainable, Transformational and Accessible Water Interventions (STAWI) Activity contract number 72061523C00001with DAI Global LLC. The above contract was originally awarded to DAI, using full and open competition on March 31, 2022, with a period of performance ending January 24, 2028. To support the United States Government’s (USG) efforts to mitigate the food security crisis exacerbated by Russia’s invasion of Ukraine and alleviate the immediate challenges of hunger and food insecurity caused by prolonged drought in the Horn of Africa, USAID/KEA requires a modification to the STAWI-Contract under Ukraine Supplemental (#4).
Extending the ceiling for the STAWI Contract will enable the Contractor to provide the following services;
to mitigate the macro-economic shocks of Russia’s invasion of Ukraine:
a) Support vulnerable counties in the management of scarce water resources, including water sector drought recovery coordination and continuity planning at county and community levels.
b) Support service providers to resume/maintain services in the face of diminished purchasing power due to the macroeconomic impact of the war in Ukraine and the drought; strengthen security of water infrastructure (asset protection), with consideration given to climate-resilient and energy-efficient schemes.
c) Support farmers, pastoralists, agro-pastoralists and value addition enterprises to improve the use of water within agriculture and livestock market systems.
d) Foster learning and collaboration through joint planning, feedback loop to capture local voices, and knowledge dissemination events and/or platforms on leveraging development investments to increase resilience during recurrent crises
USAID/KEA intends to negotiate non-competitively with only one source (DAI) under the authority of USAID Acquisition Regulation AIDAR 706.302.70(a)(2) which provides that “full and open competition need not be obtained when it would impair or otherwise have an adverse effect on programs conducted for the purposes of foreign aid, relief, and rehabilitation”. In addition, the exception to competition for the use of the Additional Ukraine Supplemental (#4) under the STAWI contract is based on the exception to competition in AIDAR 706.302.70(b)(5) which authorizes the waiver of full and open competition “for the continued provision of highly specialized services when award to another resource would result in substantial additional costs to the Government or would result in unacceptable delays.” The period of performance remains unchanged.
This is not a request for proposals. However, the Government may consider all expressions of interest received within fifteen (15) calendar days after date of publication of this notice. A determination not to compete this proposed follow-on contract based upon responses to this notice, if any, is solely within the discretion of the Government. Information or responses received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement. Therefore, any responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to USAID and would not hinder USAID/KEA objectives.
