About this file
This is a Notice of Intent to Award a Sole Source Contract from the U.S. Army Corps of Engineers, St. Paul District. The contract (W912ES26PA042) is intended for repair services of a Caterpillar D6H bulldozer (Serial No. 03ZF06223 with 6,445 operating hours) and will be awarded to John Fabick Tractor Co, located at 1 Fabick Drive, Fenton, Missouri 63026-2928. The scope of work includes replacing track links, bushings, and all twelve track rollers using Original Equipment Manufacturer (OEM) parts and OEM-certified technicians. The NAICS code assigned is 811310 (Commercial and Industrial Machinery and Equipment Repair and Maintenance).
The sole source justification is based on specific technical requirements mandating the use of OEM parts and OEM-certified technicians, which the Government contends are available exclusively through Caterpillar's authorized dealer network. John Fabick Tractor Co (operating as Fabick CAT) is identified as the only authorized Caterpillar dealer with exclusive geographic territory coverage for western Wisconsin and eastern Minnesota. Responsible sources believing they can meet the stated requirements may submit written notification to Contract Specialist John Riederer at John.P.Riederer@usace.army.mil within three calendar days from publication or by March 5, 2026 at 12:30 PM (CST). Responses must include supporting evidence demonstrating compliance with requirements; however, the Government retains sole discretion to determine whether to compete the procurement based on any responses received.

NOTICE OF INTENT TO AWARD SOLE SOURCE THIS IS NOT A REQUEST FOR COMPETITIVE
PROPOSALS. This is a notice of intent to solicit and award a sole source contract under statutory authority 41 U.S.C. 1901 (a) (1) as implemented by FAR 13.106-1 only one responsible source and no other supply of service will satisfy agency requirements. The U. S. Army Corps of Engineers, St. Paul District intends to solicit and award a sole source contract to repair the undercarriage of a Caterpillar D6H bulldozer, Serial No. 03ZF06223 with 6445 hours, replacing track links and bushings and all twelve track rollers to John Fabick Tractor Co, 1 Fabick Dr, Fenton, MO 63026-2928. NAICS Code 811310 Commercial and Industrial Machinery and Equipment (except Automotive and Electronic) Repair and Maintenance.
Specific characteristics of the repair services that limit the availability to a sole source are the requirements that the repair must be performed using OEM parts and completed by OEM certified technicians and that the parts supplied be genuine OEM parts. It is the Government’s belief that only this suggested source can furnish the requirements, to the exclusion of other sources, because the original equipment manufacturer, Caterpillar Inc. distributes OEM parts and OEM certified technicians exclusively through its network of dealerships. The dealerships have exclusive geographic territories. John Fabick Tractor Co (DBA Fabick CAT) is the only dealer and therefore is believed to be the only source of OEM parts and certified technicians for western Wisconsin and eastern Minnesota.
This notice satisfies the requirement at FAR 5.201(b)(1), to publicize the proposed contract action. This notice of intent is not a request for competitive proposals or quotes. No solicitation documents are available; however, all responsible sources that believes that they can meet the requirements may give written notification to the Contracting Officer within 3 Days from the date of publication of this notice. Supporting evidence must be furnished in enough detail to demonstrate compliance. Information must be sent electronically to John Riederer, Contract Specialist, at John.P.Riederer@usace.army.mil. Any responses received will be evaluated;
however, a determination by the Government as to whether to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government. Responses must be received within 03 days of publication or by March 5, 2026 at 12:30 PM (CST) to be considered.
