The statutory authority for this sole source procurement is prescribed by FAR 13.501(a).

The Department of Defense (DoD), Washington Headquarters Services, Acquisition Directorate, (WHS/AD) intends to issue a sole source, firm fixed price contract to Air Pollution Control (APC) Products, Inc., 10967 Richardson Road, Ashland, VA 23005, to procure a Class I and IV Virginia Licensed Facility Operator and OEM Qualified technician(s) to perform maintenance on two existing Incinerators.

This requirement is in support of the Pentagon Force Protection Agency (PFPA) to obtain a Class I and IV Virginia licensed Facility Operator and OEM qualified technician to perform preventative maintenance, normal repairs, emergency unscheduled repairs and system operation for two Incinerators located at the Pentagon Classified Waste Destruction Facility, including all labor, parts, materials and travel associated with keeping the facility operable at all times. The Modicon Programmable Logic Controls (PLC) are proprietary to Consutech and only an authorized dealer of the manufacturer is able to receive award. The current system in place has a lifespan of another 25 years.

A follow-on contract with the incumbent is required to ensure the proper operation of the two incinerators currently in use at the Pentagon. The current incinerators work under the proprietary design and use of Consutech Systems, LLC. The intellectual property and licensing rights are solely owned by Consutech Systems, LLC. The requirement can only be satisfied by the incumbent due to it being the only business in the National Capitol Region (NCR) that meets Consutech Systems, LLC standards and is capable of providing the services within the NCR.

This procurement is being conducted in accordance with Federal Acquisition Regulation (FAR) 13.5 under the authority of 41 U.S.C 1901, Simplified Acquisition Procedures. This notice of intent is NOT a request for proposal or quotation. Request for copies of a solicitation in response to this notice will not be honored or acknowledged. However, any responsible sources may submit a capability statement demonstrating the ability to provide the requested products, which shall be considered as market research purposes for future purchases of the required products.
