Notice of Intent for Other than Full and Open Competition
Solicitation Number: RFP No. SOL-720-482-18-R-00002 Notice Type: Special Notice
Agency: US Agency for International Development (USAID) Office: Overseas Missions Location: USAID/ Burma
USAID/Burma intends to negotiate a non-competitive modification of contract number 720-482-08-C-00002 (USAID/Burma Promoting Rule of Law (PRLM) Activity) with Chemonics, 1717 H ST NW, Washington DC 20006-3900. The above contract was awarded to Chemonics, based on full and open competition, on June 26, 2018.
The USAID/Burma PRLM activity, within Mission’s Office for Democracy, Governance and Humanitarian Assistance’s portfolio, has been supporting broader democracy, governance, conflict mitigation, and resilience activities designed to protect human rights and advance the democratic transition and peace process. The project core objectives include:
● Strengthen the administration of justice
● Improve the quality of professional legal education
● Strengthen access to justice services
● Mitigate the impacts of trafficking and corruption, and support transitional justice
The non-competitive extension modification will increase the services to:
● Support grantees to provide legal advice and representation to the accused.
● Train paralegals, law students and junior lawyers in access to justice and transitional justice.
● Support survivors and those vulnerable to trafficking and sexual and gender-based violence (SGBV), strengthen the referral mechanisms for survivors of trafficking in persons (TIP), and develop a survivors’ bill of rights for TIP victims.
● Establish means to support victims of SGBV outside the formal justice system.
● Mentor and support civil society organizations to provide reporting and advocacy with a focus on women and traditionally marginalized groups.
The additional resources will also support human rights defenders, counter trafficking in persons activities, and assist in the development of access to justice opportunities.
USAID/Burma intends to negotiate non-competitively with only one source (Chemonics) in accordance with FAR 6.302-1. The modification of the award will extend the period of performance of the contract by approximately one year from June 25, 2023 to June 26, 2024 and the estimated cost of this extension is expected to exceed the simplified acquisition threshold.
This is not a request for proposals. However, the Government may consider all expressions of interest received within fifteen (15) calendar days after the date of publication of this notice. A determination not to compete this proposed contract modification based upon responses to this notice, if any, is solely within the discretion of the Government. Information or responses received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement.
Therefore, any responses to this notice must demonstrate clear and convincing evidence that competition would be advantageous to USAID and would not hinder USAID/Burma’s objectives. Please direct any responses to this notice to Mr. Gregory Wang, Contracting Officer, at gwang@usaid.gov with a copy to Ya Min Thu at ymthu@usaid.gov.
