About this file
This document is a Notice of Intent for a Pre-Solicitation Non-Competitive Contract Opportunity. The National Institute of Child Health and Human Development (NICHD), in support of the National Institute of Diabetes, Digestive, and Kidney Diseases (NIDDK), intends to award a sole-source contract to Coherent, Inc. for a 5-year Productivity Plus Bronze Maintenance Agreement for a Discovery NX femtosecond laser. The equipment is used daily and is critical to an ongoing research project, requiring continuous service and minimal downtime. The contract will be for a 12-month/5,000-hour period, with four 1-year option periods, from 12/19/2024 to 12/18/2029. The justification for the non-competitive award is that Coherent is the sole provider of the technical support and service essential for the development and maintenance of the laser system. Interested parties may respond with information on their capabilities, pricing, and delivery by 12/4/2024, but the government is under no obligation to consider the responses.

CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION (INCLUDING BRAND-

The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10—Market Research. Only one source is available: Per FAR 13.106-1(b)(1) the Contracting Officer has determined that Coherent is the sole provider.
These lasers will be incorporated into NIDDK’s existing microscope systems, which have been developed and maintained by Lab personnel, in a sense as OEM applications. We therefore will be depending on direct availability of technical advises and service from the company that produces these lasers. Technical support from independent dealerships beyond being an intermediary for warranty services are unavailable, causing disrupted work, which we cannot afford. The types of technical support essential for the development and maintenance of our instrument is only reliably available from the manufacturer of these lasers, Coherent, Inc.
