About this file
This is a Notice of Brand Standardization issued by Water Environment Services (WES), a division of Clackamas County in Oregon, dated September 24, 2026. The document grants an exemption from brand name specifications for 3-Way Transfer Switches, critical electrical components used in WES pump station systems that enable safe connection of portable backup generators during power outages. This standardization applies to a class of solicitations and remains effective for ten years, expiring on December 31, 2030. The 3-Way Transfer Switches are essential for maintaining continuous pump station operation, preventing sanitary sewer overflows, and ensuring regulatory compliance.
WES determined that the Caterpillar brand specification meets its needs based on one or more of the following factors: the specification is unlikely to encourage favoritism or substantially diminish competition; it would result in substantial cost savings; and efficient utilization of existing goods requires acquisition of compatible products. Vendors may submit written protests regarding this brand standardization notice to Procurement Director Ryan Rice at rrice@clackamas.us within fourteen calendar days from the issuance date, with a deadline of 5:00 PM. This determination follows ORS 279B.215 and Local Contract Review Board Rules C-047-0700.

Description of Goods: 3-Way Transfer Switches
Notice is hereby given by Water Environment Services (“WES”), through its Procurement
Division, that it is seeking exemption from brand name specifications within a class of solicitations.
1. 3-way transfer switches are critical components within WES’ pump station electrical systems that allow for safe and efficient connection of portable backup generators during power outages, ensuring continuous operation of pump stations and preventing sanitary sewer overflows. Backup generators, and the ability to connect them to WES infrastructure via 3-way transfer switches, are critical components that ensure regulatory compliance and system reliability.
2. According to ORS 279B.215, the County has determined that for the class of solicitations that include 3-Way Transfer Switches only the identified brand name specification listed above will meet the needs of WES based on one or more of the following written determinations:
a) That use of a brand name specification is unlikely to encourage favoritism in the awarding of public contracts or substantially diminish competition for public contracts;
b) That use of a brand name specification would result in substantial cost savings to the
WES; and/or
c) That efficient utilization of existing goods requires the acquisition of compatible goods or services.
3. This Standardization is for a Class of Solicitations. This Standardization shall be effective for the next ten (10) years, expiring on December 31, 2030.
4. In accordance with Local Contract Review Board Rules C-047-0700, a vendor may submit protests regarding this notice to the Procurement Director, Ryan Rice, rrice@clackamas.us. Written comments must be received by 5:00PM, within fourteen
