About this file

This document is an excerpt from the National Organic Program (NOP) regulations under 7 CFR Part 205, specifically addressing inspection and testing requirements for agricultural products labeled as organic. The regulations establish mandatory testing and sampling protocols for the U.S. Department of Agriculture's organic certification program. The document outlines inspection procedures that certifying agents must conduct on agricultural products intended for sale or labeling as "100 percent organic," "organic," or "made with organic" ingredients. Testing protocols require sampling of soil, water, seeds, plant tissue, and plant, animal, and processed products to identify prohibited substances or environmental contaminants. Certifying agents must sample and test a minimum of five percent of their certified operations annually, rounded to the nearest whole number, with a minimum requirement of at least one operation annually for agents certifying fewer than thirty operations. Sample collection must be performed by an inspector representing the USDA Administrator, applicable state organic program's governing state official, or the certifying agent, with sample integrity maintained throughout the chain of custody.

Chemical analysis must be conducted using methods described in the Official Methods of Analysis of the AOAC International or other applicable validated methodology for determining contaminants in agricultural products. All analyses must be performed in accredited laboratories at the certifying agent's expense. Test results are available for public access unless the testing is part of an ongoing compliance investigation. If test results indicate pesticide residues or environmental contaminants exceeding FDA or EPA regulatory tolerances, the certifying agent must promptly report findings to the appropriate federal health agency. Agricultural products containing prohibited substances at levels exceeding five percent of the Environmental Protection Agency's tolerance for specific residues are excluded from sale as organic. The regulations allow continued organic certification status for operations applying prohibited substances under federal or state emergency pest or disease treatment programs if the certified operation otherwise meets regulatory requirements.
