About this file

This is a Non-Competitive Memorandum for Simplified Acquisition Actions justifying a sole-source contract award to FCI Phoenix for urgent wastewater treatment equipment replacement.

The Federal Bureau of Prisons at FCI Phoenix requires immediate replacement of failed waste grinder equipment and associated supplies for its sewage wastewater treatment plant. The specific equipment needed includes one channel monster single drum grinder, two muffin monsters with controllers, and all associated equipment, supplies, and installation service labor. The grinders function to shred debris such as rags, plastics, and wipes that prevent pipe clogs and downstream equipment damage, breaking waste into uniform sizes for mixing with liquids through the chlorinator system. The estimated contract value is $133,623.31. The justification for non-competitive procurement cites urgency and compelling circumstances under 41 U.S.C. 1901(e) and 41 U.S.C. 3304(a)(2), as the current inoperable equipment has created a dire operational need with risks of wastewater backflow into housing units, environmental and regulatory non-compliance, and facility disruptions affecting both staff and inmate safety. JWC Environmental, INC (UEI: LL1MXN1FF1M6) has been identified as uniquely qualified to perform the work without delay. The contract number is 15BBNF26P60800002, and the Contracting Officer MANJIT DOLA certified the justification on September 17, 2026.

NON COMPETITIVE MEMORANDUM FOR

SIMPLIFIED ACQUISITION ACTIONS

FAR RFO 12.102 (a)

1. REQUIRING AGENCY – DOJ/Bureau of Prisons, FCI Phoenix, 37900 N 45TH AVE, Phoenix, AZ 85086

2. NATURE/DESCRIPTION OF ACTION BEING APPROVED – Urgency

3. DESCRIPTION OF SUPPLIES OR SERVICES REQUIRED TO MEET THE AGENCY’S NEEDS The agency urgently requires the replacement of the waste grinders and associated supplies for the sewage wastewater treatment plant. The current equipment is in dire need of replacement as it has become inoperable, which is causing non-organic waste to fill in the wastewater treatment plant causing catastrophic wastewater system back-up effecting the security and orderly running of the institution. One channel monster single drum, two muffin monsters with controllers and all associated equipment, supplies and service labor for installation are urgently required. The grinders are responsible for shredding debris like rags, plastics, wipes and other foreign objects from clogging pipes and prevent damage to downstream equipment. The function of the grinders is to break waste into uniform sizes that will mix the waste with liquids for moving wastewater through the chlorinator and out of the system for effluent irrigation to keep treatment pond levels within regulation and the wastewater system functioning. FCI Phoenix is not connected to municipal sewage or wastewater operations and is wholly dependent on its own facilities. A delay in replacement would result in a possible wastewater backflow into housing units affecting both staff & inmates with sewage resulting in hazardous health conditions. This will affect the orderly running of the institution and safety & security for both staff and inmates. The replacement of the sewage grinder equipment is both urgent & compelling because the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals. The estimated cost for this requirement is $133,623.31

4. IDENTIFICATION OF STATUTORY AUTHORITY PERMITTING OTHER THAN FULL AND OPEN

COMPETITION – 41 U.S.C. 1901(e); 41 U.S.C. 3304(a)(2)

5. DEMONSTRATION THAT THE PROPOSED CONTRACTOR’S UNIQUE QUALIFICATIONS OR THE

NATURE OF THE ACQUISITION REQUIRES USE OF THE AUTHORITY CITED:

At present, the sewage grinders and associated equipment have failed, and replacement of these grinders is a dire need. Temporary workarounds are no longer sustainable as stop-gap measures present immediate and severe risks for wastewater backups, environmental and regulatory non-compliance, and potential facility disruptions. JWC Environmental, INC, has been identified as being uniquely qualified to perform this work without delay. JWC Environmental, INC, has knowledge of the working with wastewater grinders and equipment and will provide a team get operations status back to normal. Immediate action is essential to mitigate further risks and to maintain operational stability in the institution. Any future requirements of similar magnitude will be procured in accordance with the competitive procedures as circumstances allow.
