COMPETITION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH
AUTHORITY 41 U.S.C. 3304(a)(1)

1. Identification of the agency and contracting activity.
The U.S. Department of Justice (DOJ), Federal Bureau of Investigation (FBI), Science and Technology Acquisition Unit (STAU), has prepared this justification for other than full and open competition for a Legacy Woodworking Machinery Maverick CNC Router Table on behalf of the Operational Projects Unit (OPU), Laboratory Division.
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
A one-time, sole source, firm-fixed price purchase order will be awarded to Legacy Woodworking Machinery (Springville, UT) for a Maverick CNC Router Table. A Notice of Intent (NOI) to Sole Source will be posted on the Federal Business Opportunities website for this requirement, which will publicize the FBI’s intent to issue an award to Legacy Woodworking Machinery. This announcement will also give an opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through a submission of their technical capabilities and cost information for consideration prior to an award being issued.
3. A description of the supplies or services required to meet the agency’s needs.
The OPU requests the funding of one (1) Maverick CNC Router Table in order to replace an existing router table which is no longer in operating condition. The procurement of the requested table will allow the OPU to accomplish its mission of providing the FBI with physical models of crime scenes to be used as trial exhibits. The estimated dollar value of this award is XX,XXX.XX.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1) as implemented by the Federal Acquisition Regulation (FAR) Subpart 6.302-1 entitled, “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.”

5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
Due to the unique requests that OPU receives from the field and in support of investigative operations, having a 5-axis turning station incorporated into the router table is a necessity in order to create features such as cylinders, cones, beads, coves, flutes, reeds, joinery, rope twist, barley twist, hollow spirals and much more. A 5-axis turning center allows you to turn, index, carve and machine between centers, even on a tapered component. The turning station should utilize the same x-y-z gantry used on the 3-axis table.
Unfortunately, both the Velox and MultiCAM router tables do not have a turning station incorporated into their system which precludes them from this comparison. However, the requested Maverick 4X8 CNC router table combines a 36 X 96 X 8 inch flat stock work area with a 10″ x 90″ turning system and an adjustable dual angle joinery table to create a 3-station CNC router table for routing, turning, and joinery. The combined cutting envelope is 48″ X 96″ X 8″. Legacy Woodworking Machinery is the sole manufacturer and provider of the Maverick 4X8 CNC router table. No third party vendors are authorized to resell Legacy’s manufactured products.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.

7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated dollar value of this award shall not exceed XX,XXX.XX. Prior to issuing an award, the Contracting Officer will determine that the proposed price is fair and reasonable in accordance with FAR 13.106-3.
8. A description of the market research conducted and the results.
Significant market research efforts conducted by the OPU led to the determination that not only is Legacy Woodworking Machinery the sole manufacturer and provider of the Maverick CNC Router Table, but the software included with the product is proprietary to Legacy Woodworking Machinery. Therefore, Legacy Woodworking Machinery is the only company capable of providing the product required by the FBI.
9. Any other facts supporting the use of other than full and open competition.

10. A listing of any sources that expressed a written interest in the acquisition.

This announcement will also give an opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through a submission of their technical capabilities and cost information for consideration prior to an award being issued.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
The actions of the OPU to identify potential sources possessing the ability to satisfy this and similar requirements are ongoing. Over time, additional sources may become available and identifiable through market surveys, trade shows, magazine articles, collaboration with other Federal agencies, or other means. The ability to predict this possibility is difficult. Therefore, the barriers to competition they impose are impossible to avoid.
