About this file

This document is a Notice of Intent to Sole Source for the National Center for Advancing Translational Sciences (NCATS). The solicitation seeks the installation of NMR consoles and peripheral equipment for Agilent NMR400, 400-MR, and 600 MHz DD2 NMR systems in the recently renovated CLL NMR Lab. The procurement is classified under NAICS code 811210 for Electronic and Precision Equipment Repair and Maintenance, with a $34 million size standard. NCATS intends to negotiate directly with Agilent Technologies on a sole source basis, citing the need for a proprietary installation that preserves warranties and ensures proper setup of the specialized scientific equipment.

The solicitation (number 75N95025Q00241) requires an Agilent service engineer to unpack and install NMR components, with delivery to be made 45 days after contract award. The response deadline is August 20, 2025, at 12:00 pm EST, with all responses to be submitted electronically to Andrew Varley at Andrew.Varley@nih.gov. Interested parties may submit capability statements, though the government retains discretion on whether to proceed with a competitive procurement. All offerors must have active registration in the System for Award Management (SAM) and include specific details such as unit price, shipping costs, and business size certification in their response.

REGULATORY AUTHORITY

This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13—Simplified Acquisition Procedures. Contracts awarded using FAR Part 13—Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6—Competition Requirements. FAR Subpart 13.106-1 (b) Soliciting from a single source provides that: For purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source IF the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name OR industrial mobilization).

DESCRIPTION OF REQUIREMENT

PURPOSE AND OBJECTIVES:

The Analytical Chemistry Core (ACC) at DPI/NCATS requires the reinstallation of three Agilent NMR consoles and peripheral equipment in the recently renovated CLL NMR Lab. An Agilent service engineer is required to unpack and install these NMR components as they can ensure the appropriate standard operating procedure is taken for their proprietary NMR consoles and peripheral equipment. While installation could possibly be performed by a third party service group, Agilent claims no liability in the event an error with the components causes a system failure or damage. Furthermore, it would invalidate any additional warranties associated with the NMR magnet, console, and non-cryogenic components. As such, we require Agilent to perform the reinstallation of the NMR400, 400-MR, and 600 MHz DD2 NMR consoles, and their peripheral equipment.

Period of Performance:

Delivery shall be made 45 days ARO.
