NATIONAL PARK SERVICE

SINGLE SOURCE POLICY REQUIREMENTS

National Park Service Policy FAP&P 1443-2015-06 requires a written justification which explains why competition is not practicable. The justification must address one of the following criteria.

In order for an assistance award to be made without competition, the award must satisfy one or more of the following criteria:

(1) Unsolicited Proposal – The proposed award is the result of an unsolicited assistance application which represents a unique or innovative idea, method, or approach which is not the subject of a current or planned contract or assistance award, but which is deemed advantageous to the program objectives;

(2) Continuation – The activity to be funded is necessary to the satisfactory completion of, or is a continuation of, an activity presently being funded, for which competition would have a significant adverse effect on the continuity or completion of the activity. A single source on the basis of continuation must demonstrate that competition would result in a substantial duplicate cost to the government that cannot be recovered through competition;

(3) Legislative intent – The language in the applicable authorizing legislation or legislative history clearly indicates Congress’ intent to restrict the award to a particular recipient of purpose;

(5) Emergencies – Program/award where there is insufficient time available (due to a compelling and unusual urgency, or substantial danger to health or safety) for adequate competitive procedures to be followed.

NPS did not solicit full and open competition for this award based the following criteria:

Goals: The project goal is to implement PL 103-313. The Farmington River was designated as a National Wild and Scenic River (WSR) in August 1994 pursuant to enactment of PL 103-313. Consistent with NPS policy, and as encouraged and authorized under the Wild and Scenic Rivers Act, it is the intent of the NPS to conduct a partnership based approach to implementing designation of the Farmington Wild and Scenic River in close cooperation with local stakeholders and communities, including the Farmington River Coordinating Committee and the Farmington River Watershed Association.
PP: 1. The project engages recipients, partners, communities, and/or visitors in shared environmental stewardship.

3. The project assists in the creation, promotion, facilitation, and/or improvement of the public’s understanding of natural, cultural, historic, recreational and other aspects of areas such as ecological conservation areas, and state and local parks.

Overview: The Agreement advances the objectives of the NPS and the Recipient in their mutual desire to conserve the resources of the Farmington River through implementation of the locally-developed and updated 2013 Upper Farmington River Management Plan (Management Plan). Sub-components within this overall objective include: facilitating the transfer of appropriated funds to the Recipient for expenditure in accordance with the Management Plan and on behalf of the Farmington River Coordinating Committee representing the towns of Barkhamsted, Canton, Colebrook, Hartland, and New Hartford; and facilitating the undertaking of specific projects approved by the FRCC. Projects as outlined in the Management Plan include: Water Quality Monitoring, Education and Outreach, Project Review, Land Protection Assistance and Conservation, Recreation and Public Enjoyment, and Wildlife and Ecology.

3. Recognize RECIPIENT participation and give appropriate credit in all efforts which benefit from this collaboration.

4. Review and analyze program results regularly with RECIPIENT.

5. Provide such other support as mutually agreed upon and specified in amendments to this Agreement.

Justification: PL 103-313 requires the NPS to administer the Wild and Scenic River designation in collaboration with the Farmington River Coordinating Committee (FRCC), consistent with the Partnership Wild and Scenic River model. The CA with FRWA provides funds to implement annual work plans of the FRCC under direction of River Management Plan. The FRCC has chosen FRWA as the FRCC member best suited to enter into a CA with the NPS through a unanimous vote. FRWA has been serving this capacity for close to twenty years and is therefore uniquely qualified. FRWA is a 501(c)3 organization, with a long and successful track record in regional river conservation and working along with local organizations, towns, state and federal agencies in the watershed. Based on these factors no other entity could fulfill this purpose for the Farmington Wild and Scenic River.
