About this file
This is a Presolicitation Notice and Notice of Intent to Sole Source issued by the National Institute of Standards and Technology (NIST), U.S. Department of Commerce. NIST anticipates procuring an AXIS DLD Maintenance & Service Agreement for comprehensive on-site service, repair, and preventative maintenance of a NIST-owned Kratos Axis Ultra DLD X-Ray Photoelectron Spectrometer. The contract will be awarded on a noncompetitive basis to Kratos Analytical, the Original Equipment Manufacturer, in accordance with FAR Part 12-102(a). The services include seven days (56 hours) of on-site labor time usable for preventative maintenance visits, up to two emergency service call-outs, or a combination thereof; unlimited technical support via phone, email, and remote assistance; and coverage of flights and travel. Services cover the entire spectrometer including all accessories, software/data system, Ultraviolet Photoelectron Spectroscopy capability, and heated/chilled sample capability, but exclude the water chiller, computer, printers, monitors, and parts supply. An additional 12-month option period is included.
The anticipated contract type is Firm-Fixed Price, to be awarded using Simplified Acquisition Procedures. The estimated period of performance is September 2026 through September 2028, with an anticipated award date of September 2026. Performance will occur at the NIST Gaithersburg campus, 100 Bureau Drive, Gaithersburg, Maryland 20899. The noncompetitive action is justified because market research indicates no alternative sources can meet the requirements, as Kratos is the sole provider of OEM-certified parts, software source code, and specifically trained technicians required to maintain system integrity and warranty standards. The Contracting Officer is Donald Graham (donald.graham@nist.gov, 301-975-6753). Responsible sources believing they can satisfy the requirement may submit capability information to the Contracting Officer. This notice is informational and not a request for proposals, quotations, or bids.
