OVERVIEW

This Agreement between the U.S. Bureau of Reclamation, Upper Colorado Region (Reclamation) and the State of Colorado's Office of Archaeology and Historic Preservation (State) is designed to facilitate information sharing and data management pursuant to two sections of the National Historic Preservation Act of 1966, as amended through 2016, (54 U.S.C. § 300101 et seq. - Public Law 113-287). 54 U.S.C. § 306131 (a)(1)(C) of NHPA requires Federal agencies to ensure that records and other data, including data produced by historical research and archaeological surveys and excavations are permanently maintained in appropriate data bases and made available to potential users. Furthermore, § 302303(a) and (b)(1) states that State Historic Preservation Officers shall administer historic preservation programs in cooperation with Federal agencies and, as part of their program, State Historic Preservation Officers shall direct and conduct a comprehensive statewide survey of historic properties and maintain inventories of such properties. Because of these mandates, and because of their previous work in establishing and maintaining a statewide survey of historic properties, the State is uniquely qualified and willing to perform the services described here

RECIPIENT INVOLVEMENT

Under this agreement, the State shall continue to direct and conduct a statewide survey of historic properties and to maintain inventories of such properties. The State shall provide access to this information to Reclamation, other agencies, and others subject to the restrictions on disclosure of information in 54 U.S.C. § 307103.

Task 1. Administer the State Historic Preservation Program in cooperation with Reclamation and other Federal agencies. This includes maintaining inventories of cultural resources or historic properties.

Task 2. Meet with Reclamation at least once a year during the duration of the agreement, either over the phone or in person, to update each other on progress or problems.

Task 3. Provide to Reclamation or their designated contractors or permittees, on an as-needed basis, cultural resources information, especially for the purpose of file or literature searches.

Task 4. Maintain and update the statewide survey, including data provided by Reclamation, their contractors or permittees.

RECLAMATION INVOLVEMENT

Substantial involvement on the part Reclamation is anticipated for the successful completion of the objectives to be funded by this award. In particular, Reclamation will be responsible for the following:

1. Submit all site forms, reports and associated cultural resource records to the SHPO, as specified in the Colorado Cultural Resource Survey Manual. It is understood that following their review and comment on Reclamation undertakings or other historic preservation programs, the new data will be input into the statewide survey.

2. Meet with the State at annually once during the duration of the agreement, to update each other on progress or problems and to ensure that Reclamation's information is being efficiently submitted, managed and maintained.

SINGLE-SOURCE JUSTIFICATION

DEPARTMENT OF THE INTERIOR

SINGLE SOURCE POLICY REQUIREMENTS

Department of the Interior Policy (505 DM 2) requires a written justification which explains why competition is not practicable for each single-source award. The justification must address one or more of the following criteria as well as discussion of the program legislative history, unique capabilities of the proposed recipient, and cost-sharing contribution offered by the proposed recipient, as applicable.

In order for an assistance award to be made without competition, the award must satisfy one or more of the following criteria:

(1) Unsolicited Proposal – The proposed award is the result of an unsolicited assistance application which represents a unique or innovative idea, method, or approach which is not the subject of a current or planned contract or assistance award, but which is deemed advantageous to the program objectives;

(2) Continuation – The activity to be funded is necessary to the satisfactory completion of, or is a continuation of an activity presently being funded, and for which competition would have a significant adverse effect on the continuity or completion of the activity;

(3) Legislative intent – The language in the applicable authorizing legislation or legislative history clearly indicates Congress’ intent to restrict the award to a particular recipient of purpose;

(4) Unique Qualifications – The applicant is uniquely qualified to perform the activity based upon a variety of demonstrable factors such as location, property ownership, voluntary support capacity, cost-sharing ability if applicable, technical expertise, or other such unique qualifications;

(5) Emergencies – Program/award where there is insufficient time available (due to a compelling and unusual urgency, or substantial danger to health or safety) for adequate competitive procedures to be followed.

Reclamation did not solicit full and open competition for this award based the following criteria:

(3) Legislative Intent and (4) Unique Qualifications

Single Source Justification Description:

The Bureau of Reclamation, Upper Colorado Region plans to enter into a grant with the Colorado Office of Archaeology and Historic Preservation to help support their ongoing maintenance of a statewide database of archaeological and historical site information. Sole sourcing is warranted because the State has mandated responsibilities under the National Historic Preservation Act to maintain a statewide database and to cooperate with Federal agencies in maintaining such records and in disseminating this information to the public interested in historic preservation.

The legislation (National Historic Preservation Act of 1966, as amended through 2016 (Public Law 113-287) specifically authorizes the award to a State to carry out preservation responsibilities of a Federal Agency.

The Colorado Office of Archaeology and Historic Preservation (SHPO) Archaeological Information Management Section is uniquely qualified to perform the activity based upon a variety of demonstrable factors such as their mandated responsibilities under NHPA, 54 U.S.C. 302303.

STATUTORY AUTHORITY

National Historic Preservation Act of 1966, as amended through 2016 (P.L. 113-287). The authority also includes the Historic Sites Act of 1935, as amended (49 Stat. 666; 16 U.S.C. 461-467).

Section 306109 of Public Law 113-287 states: A Federal agency may include the costs of preservation activities of the agency under this division as eligible project costs in all undertakings of the agency or assisted by the agency. The eligible project costs may include amounts paid by a Federal agency to a State to be used in carrying out the preservation responsibilities of the Federal agency under this division, and reasonable costs may be charged to Federal licensees and permittees as a condition to the issuance of a license or permit.
