Vendor Questions/Comments
SSC Responses
Vendor QUESTION/COMMENTs and SSC Responses:
1. QUESTION/COMMENT:
PART I. SF 1449 Continuation, BLOCK 19 - 24: It is my understanding this table is to be used by the supplier to enter their proposed fixed coefficient. Will Stennis supply the Estimated FERC
Unit price used in the table? Is the Estimated Delivery Cost the sum of the FERC Unit Price and the
Fixed Coefficient? It is our understanding the transport costs including fuel are a separate line item on the invoice to the facility?
RESPONSE:
Yes, SSC will provide the Estimated FERC Unit price in the table. (See page one (1) of attached document titled NNS16577543R AMENDMENT 001 REPLACEMENT PAGES for the updated table.)
Correct, the Estimated Amount is the sum of the Est FERC Unite Price and the Fixed Coefficient.
Correct, the transport cost is a separate line item on the invoice.
2. QUESTION/COMMENT:
PART I. SF1449 Continuation, BLOCK 15: Deliver to: It indicates that there may be new station locations to be determined at a later date. Will the facility cover all costs associated with a new station?
SSC has determined there will not be any additional stations in the future, and this language has been removed. (See page two (2) of attached document titled NNS16577543R AMENDMENT 001
REPLACEMENT PAGES for updated BLOCK 15: Deliver to: .)
3. QUESTION/COMMENT:
PART II. CONTRACT CLAUSES, FAR 52.217-9 -- Option to Extend the Term of the
Contract (Mar 2000): This indicates that the supplier will have a 15 day notice of extension of the contract, with a non-binding preliminary notice of 60 days. It is our understanding from Gulf South that this is not enough time for the supplier to extend an uninterruptible transport agreement.
The successful contractor is expected to provide an uninterruptible supply of natural gas. If offerors believe the terms and conditions of this solicitation and resultant contract do not feasibly allow for uninterruptible service, offerors are free to propose alternative solutions for consideration.
4. QUESTION/COMMENT:
PART II. CONTRACT CLAUSES, FAR 52.241-3 Scope and Duration of Contract. (FEB
1995):
(a) This indicates that the supplier needs to serve the government with uninterruptible supply of natural gas. This is also addressed in other sections of the RFP. Should the government require uninterruptible supply, a transport service with a firm component will be required. Please see comments later in the QUESTION/COMMENTs covering transportation.
(c) Contractor shall provide the Government with one complete set of rates, terms, and conditions of service which are in effect as of the date of this contract and any subsequently approved rates.
Is this referring to the tariff in place for Gulf South? Do you want a copy of their tariff?
(d) The Contractor shall be paid at the applicable rate under the tariff and Government shall be liable for the minimum month charge, if any specified in this contract commencing with the period in which service is initially furnished and continuing for the term of this contract.
What is this referring to? Is it referring to the demand charge on the Gulf South Transportation agreement that will need to be in place to serve uninterruptible supply?
Clause 52.241-3 is removed from this solicitation and any resultant contract.
5. QUESTION/COMMENT:
PART III, ATTACHMENT A, PERFORMANCE WORK STATEMENT, 2. POINT OF
DELIVER: One additional Station in the future is indicated. Will the transportation agreement in place have this amended as a delivery point, and will the facility cover all costs associated with setting up the new station?
SSC has determined there will not be any additional stations in the future, and this language has been removed from the PWS. (See page six (6) of attached document titled NNS16577543R
AMENDMENT 001 REPLACEMENT PAGES for updated PWS.)
6. QUESTION/COMMENT:
PART III, ATTACHMENT A, PERFORMANCE WORK STATEMENT, 5. FILINGS WITH
REGULATROY AUTHORITIES: “Contractor shall file and pay for any filings covering this contract the federal, state, and local regulatory authorities.”
What filings is this referring to?
SSC is relying on the successful offeror to be knowledgeable of and fully responsible for any filings that may be necessary in the performance of this contract
7. QUESTION/COMMENT:
PART III, ATTACHMENT A, PERFORMANCE WORK STATEMENT, 8. QUALITY: The quality specifications in the contract are more restrictive in some areas than the Gulf South pipeline quality specifications. Since the gas is comingled, I do not see how a supplier can abide by the specifications in the contract. I have included the gas specifications from the pipeline.
The PWS has been modified (See page seven (7) of attached document titled NNS16577543R
AMENDMENT 001 REPLACEMENT PAGES for an updated PWS) to state that quality shall be in accordance with Gulf South Pipeline Company FERC NGA Gas Tariff Seventh Revised Volume No. 1, Effective February 1, 2011, Section 6.3 GT&C- Quality of Gas Version 2.0.0).
8. QUESTION/COMMENT:
PART III, ATTACHMENT A, PERFORMANCE WORK STATEMENT, 9.
MEASUREMENT (d): It is my understanding that the equipment at the metering station would be owned, operated, maintained, and read by Gulf South.
The government neither owns, operates or maintains the equipment at the metering stations nor is the government aware of who owns, operates or maintains the equipment at the metering stations.
9. QUESTION/COMMENT:
PART III, ATTACHMENT A, PERFORMANCE WORK STATEMENT, 10. PIPELINE
AGREEMENT: In our discussions with Gulf South, this requirement will need to be reviewed and addressed further.
It is our understanding that the government expects the supplier to have their own NNS agreement beginning with the first day of the term of the agreement. The government will pay for both their
NNS demand charges along with the supplier’s new NNS agreement demand charges until the government’s transport expires. At that time only the supplier’s NNS agreement will be charged.
It is our understanding that these costs will be shown on the invoice as an additional line item monthly. The government would be invoiced on the volume of gas received into the transport agreement monthly for ultimate delivery to the facility.
Correct, the costs for the NNS are to be invoiced monthly as a separate line item. However, it is not the government’s intent to pay for two NNS agreements at the same time. The government’s intent is for the contractor to utilize the existing agreement until its expiration and to establish their own agreement to be effective upon the expiration of the existing one.
10. QUESTION/COMMENT
PART IV. SOLICITATION PROVISIONS 3. Addendum to 52.212-1 General Instructions. g.
Current transport agreement: It is indicated that the current transportation will be transferred to the successful Offeror. Does that mean the agreement will be assigned to the contractor in order for nominations to occur, or does that mean you are giving the supplier ownership? Is the transport charge added as an additional line item on the invoice as a pass through, or does the contractor need to convert this charge and include it in the adjustment factor? When a new transport agreement is held by the contractor, will the cost be shown as an additional line item on the invoice as a pass through cost, or does the contractor need to convert this charge and include it in the adjustment factor?
The current uninterruptible transport agreement between NASA and Gulf South will not be transferred to the successful offeror. However, a copy of the agreement will be provided to the successful offeror for nomination until its expiration.
The transport charge should be a separate line item on the monthly invoice, in addition to the rate being charged for the monthly usage of natural gas.
11. QUESTION/COMMENT
PART IV. 8. Addendum to 52.212-1 a. PROPOSAL PREPARATION: I will need clarification as to how Stennis would like to see this part of the proposal. Is this a short dissertation to cover each component?
It appears there are four sections, but the ones noted as Sections seems to have some section numbers missing.
b. (PWS, Section 5) process for compliance with the filings with regulatory authority. What is this referring to?
d. (PWS, Section 8) The quality required by Stennis is more restrictive than the pipeline quality allowed by Gulf South. We will have gas quality information available from the pipeline, but Gulf
South quality specifications are different that the contract indicates.
Offerors shall provide a narrative of their proposed approach to ensure compliance with the sections of the PWS identified in Part IV Proposal Preparation. There is no minimum or maximum length requirements. Offeror is encouraged to write as much, or as little, needed to relay their understanding of the requirements along with a clear plan/process to comply with the requirements.
12. QUESTION/COMMENT:
Are you wanting only a Full Requirements Price? I know you want a Firm price for 100% requirements but are you wanting any and all gas consumed to be priced at the original first of the month price or will there be swing pricing? I can provide you the best price with a 0% swing and a reasonable +/- Index.
The government is unaware of the difference between “Full Requirements Price” and “swing pricing.” Offerors are asked to provide pricing as requested per the table provided in Part I. Block
19-24 of the solicitation package.
13. QUESTION/COMMENT:
SOW Page 16. Point 2.
POINT OF DELIVERY
The point of delivery of natural gas shall be the North Fee Area Boundary of SSC (Station
LocationNumber – 2568) “and one additional Station Location Number to be determined at a later date.” The additional location to be added at a later date is a little concerning. Do you know where the additional point will be located? Would you be willing to put in some language that would limit the additional point to roughly the same area of the current Delivery Point?
SSC has determined there will not be any additional stations in the future, and this language has been removed from the PWS. (See page six (6) of attached document titled NNS16577543R
AMENDMENT 001 REPLACEMENT PAGES for updated PWS.)
