JUSTIFICATION
FOR AN EXCEPTION TO FAIR OPPORTUNITY
| 1. Contracting Activity: | Department of Veterans Affairs (VA) |
| Office of Procurement, Acquisition and Logistics | |
| Technology Acquisition Center | |
| 23 Christopher Way | |
| Eatontown, NJ 07724 |
2. Description of Action: The proposed action is for a Firm-Fixed-Price (FFP) Delivery Order issued under the National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Government-Wide Acquisition Contract (GWAC) for Video Teleconferencing and Audio Visual as a Service (VAVaaS) for the Omar Bradley Conference Room (OBCR). VAVaaS includes a brand name Cisco video teleconferencing (VTC) endpoint as well as non-brand name hardware, uninstallation services, system design, system implementation, testing, and maintenance of the system.
3. Description of the Supplies or Services: The proposed action is to obtain one Cisco brand name VTC endpoint, three high definition cameras, and associated AV hardware, and services for the OBCR for the Secretary of the Department of Veterans Affairs (SECVA) located at the Veterans Affairs Central Office (VACO) in Washington, DC. The equipment and services will be used to perform a tech refresh for OBCR Executive VTC and AV system. SECVA requires VTC endpoints to communicate via two-way audio and video connections provided within the VA’s Cisco based Enterprise Video Tele-Conference Network (EVTN). SEVCA communicates with all VA facilities nationwide. The period of performance for this effort shall be 12 months, inclusive of the delivery and installation of the equipment which shall be completed within 45 days from receipt of the order, as well as four 12-month option periods and two optional tasks. The total estimated value of the proposed action is -- , inclusive of the options; however, the total estimated cost for the Cisco brand name portion of the effort is --.
4. Authority: Pursuant to Federal Acquisition Regulation (FAR) 16.505(a)(4), the following brand name requirement is being justified and approved as an exception to fair opportunity under the statutory authority of Section 41 U.S.C. 4106(c)(2) as implemented by FAR 16.505(b)(2)(i)(B), entitled “Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized”.
5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in Section 8 of this document, it has been determined that limited competition is available among authorized resellers for the required Cisco VTC equipment. VACO EVTN is a dedicated, Cisco based video device network that has undergone extensive enhancements in the last four years to improve system redundancy and creating a high-availability model that is robust, and highly utilized. The use of any other brand name VTC equipment will result in interoperability issues with the EVTN system, as only the system communicates with endpoints through proprietary software. Specifically, only the brand name Cisco VTC equipment meets VA’s requirement to allow for simple network management protocol (SNMP) communication from the VTC endpoints to the Telepresence Management System (TMS). While SNMP is a standard protocol, the application of the SNMP for Cisco brand name VTC endpoints is unique. SNMP is used to provide constant communication between the VTC endpoints and the core infrastructure system to report its status and provide information needed to perform maintenance tasks. Without the required functionality, the endpoint will not be accessible to be controlled and managed by the VACO Information Technology Services and Support (ITSS) staff. SNMP is required to provide device status and monitoring, scheduling and remote configuration in real time without having to log in to the device manually.
Furthermore, the EVTN utilizes Cisco proprietary software through SNMP to provide, monitor, control and maintain the EVTN video phonebook information of each VTC endpoint. This VA requirement is only provided by Cisco and provides VA, specifically VACO, with the ability to look up and contact any facility that is part of the EVTN, saving crucial time in the event of emergencies or events in which VACO must be in contact with the field without delay to set up/configure dial-in networks. Also the ability to upgrade the system software remotely from TMS. In addition, no other source, other than a Cisco reseller can provide the services without access to Cisco’s proprietary code. Access to the code is required to ensure all services provided are properly configured.
6. Efforts to Obtain Competition: Market research was conducted, details of which are in the Section 8 of this justification. This effort did not yield any additional sources that can meet the Government’s requirements. It was determined, however that limited competition is viable among authorized resellers for this brand name item. In accordance with FAR 16.505(a)(4)(iii)(A), this justification will be provided with the solicitation to all appropriate NASA SEWP V GWAC holders.
7. Actions to Increase Competition: The Government will continue to conduct market research to ascertain if there are changes in the marketplace that would enable future actions to be competed.
8. Market Research: Market research was conducted by VACO ITSS subject matter experts from November 2020 to January 2021. Market research consisted of VA technical personnel reviewing products similar to Cisco VTC devices. Based on the research, the Government’s technical experts determined that no other product can integrate into the existing VA EVTN and maintain full functionality. Other VTC systems brand names such as Polycom and Lifesize do not use SNMP and do not communicate with TMS and the corporate phonebooks do not display on these systems. Review of these products was based on actual VA experience using said brand name equipment on VA’s EVTN environment. Additionally, VA VTC subject matter experts regularly review industry trade publications and conduct internet research to ascertain if any other equipment is available. Based on all of these market research efforts, the Government’s technical experts have determined that only Cisco brand name VTC equipment can meet all of IOC’s needs.
Further, a Request for Information (RFI) was issued on January 28, 2021, via Contract Opportunities to ascertain if there were sources that could meet the Government’s technical requirements for VAVaaS to include the required Cisco brand name equipment. The RFI closed on February 5, 2021, with nine responses received. Four of the nine responses were from Service-Disabled Veteran Owned Small Businesses (SDVOSB). Based on the information provided, the Government Program Manager determined seven vendors (West Star Corporation, TechAnax, Point Breeze Communications, York Telecom Corporation, V3Gate, Tuwyn LLC, and Corbett Technology Solutions, Inc.) to be technically capable of performing the effort. Two of the vendors capable of meeting the requirements are SDVOSB NASA SEWP contract holders.
In January 2021, the Contract Specialist conducted additional market research using the NASA SEWP V Provider Lookup Tool to ascertain the extent of limited competition among resellers of the required brand name Cisco products. Through the use of the Provider Look-Up Tool on the NASA SEWP V GWAC website, 24 Service-Disabled Veteran-Owned Small Businesses were identified as resellers of the required brand name Cisco products. Based on this market research, limited competition is anticipated.

11. Fair and Reasonable Cost Determination: I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable based upon anticipated competition and discounts among NASA V GWAC holders who are authorized resellers of the required brand name Singlewire Software Maintenance described herein. Finally, price analysis shall be conducted by comparing the successful quote to the Independent Government Cost Estimate.
