JUSTIFICATION
FOR AN EXCEPTION TO FAIR OPPORTUNITY
| 1. Contracting Activity: | Department of Veterans Affairs (VA) |
| Office of Procurement, Acquisition, and Logistics | |
| Technology Acquisition Center | |
| 23 Christopher Way | |
| Eatontown, New Jersey 07724 |
2. Description of Action: This proposed action is for a firm fixed-price delivery order to be issued under a National Aeronautics and Space Administration (NASA) Solutions for Enterprise-Wide Procurement (SEWP) V Government-Wide Acquisition Contract (GWAC) for the renewal of brand name Computer Associates (CA) Technologies, Inc. Identity and Access Management (IAM) software maintenance and technical support.
3. Description of the Supplies or Services: VA Office of Information and Technology, Service Delivery and Engineering, Enterprise Systems Engineering, has a requirement to renew enterprise-wide software maintenance and technical support of existing brand name CA Technologies IAM software used by VA for its IAM software solution and Personal Identity Verification (PIV) services. VA uses the customized, unlimited user CA Technologies IAM software for identity administration and real-time authentication enforcement. This IAM software solution addresses VA’s requirements for create, modify, and delete functions in the administration of network user accounts, user profiles, and access policies across the heterogeneous VA information technology environment via a combination of user roles and business rules. This IAM software solution also provides for the capability to abstractly and automatically correlate data and support centralized management of user identities, where administrative roles and user roles can selectively adjust identity relationship and identity traits for entities or groups. In addition, this software solution supports monitoring of decentralized events that relate to network user identities, where end points are monitored for identity related adjustments and those monitored events are then reported to the centralized component of the solution as an input to determine any subsequent changes that may be required in the scope of network user identity lifecycle management.
The required software maintenance shall consist of all standard upgrades, patches, fixes, updates, and security resolutions developed by CA Technologies. The technical support services shall provide for the analysis, troubleshooting, and resolution of any software product-related problems or questions encountered by Government users with the specified software products. These maintenance and technical support services are provided 24/7/365, and will ensure the current software is continually updated and remains fully operational. The proposed action is for services only. No hardware or software will be renewed or procured under this proposed action. The period of performance is 12 months, from May 1, 2020 through April 30, 2021, with two 12-month option periods for continued software maintenance and technical support. The total estimated value of the proposed action, inclusive of all options, is $---.
4. Statutory Authority: Pursuant to Federal Acquisition Regulation (FAR) 16.505(a)(4), the following brand name requirement is being justified and approved as an exception to fair opportunity under the statutory authority of Section 41 U.S.C. 4106(c)(2) as implemented by FAR 16.505(b)(2)(i)(B), entitled “Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.”
5. Rationale Supporting Use of Authority Cited Above: Based on market research, as described in Section 8 of this document, it has been determined that limited competition is available among resellers of the required CA Technologies software maintenance and technical support services on the NASA SEWP V GWAC. The proposed action is for the procurement of software maintenance and technical support services on existing CA Technologies perpetual software licenses used by VA for network user identity administration and real-time authentication enforcement. The existing CA Technologies IAM solution is a highly configurable software suite of products integrated in a complex application environment that is modified on a regular basis to support VA’s IAM capabilities. VA previously acquired these perpetual licenses and deployed this highly customized proprietary software solution from CA Technologies for IAM functionality at an enterprise level. The CA IAM software is currently the only software installed and released as a part of VA’s IAM solution. Only the CA software can provide interoperability and compatibility with the current software being used in the VA IAM solution. The current CA software solution is deployed as a System of Systems (SoS) which consists of several subsystems integrated with proprietary data and source code. The current CA software will not interface and interoperate and will not be compatible with any other software solution due to proprietary source code. Additionally, since the CA software is proprietary, no third-party source exists that provides integration, analysis, troubleshooting, and resolution of any software product-related problems other than a reseller of CA Technologies. Therefore, only software maintenance and technical support services provided by CA Technologies or a reseller can meet the requirements as the existing software is proprietary to CA Technologies. Without access to CA Technologies proprietary source code, no other source is able to provide software upgrades, patches, fixes, updates, or security resolutions. Without the required software maintenance and support, the existing CA Technologies software performance would eventually degrade and would not be usable by VA as its IAM software solution. Additionally, VA would not receive security updates, which could compromise VA’s network security posture. Since the software is proprietary, no third-party source exists that provides analysis, troubleshooting, and resolution of any software product-related problems other than a CA Technologies reseller.
6. Efforts to Obtain Competition: Market research was conducted, details of which are in Section 8 of this justification. This effort did not yield any additional sources that can meet the Government’s requirements. Currently, no other companies other than CA Technologies or a reseller can provide the required software maintenance and support for VA’s existing IAM solution. It was determined, however, that limited competition is viable among resellers for this brand name CA Technologies software and maintenance support. In accordance with FAR 16.5.5(a)(4)(iii)(A)(1), this justification will be provided with the solicitation to all appropriate NASA SEWP V GWAC holders. Furthermore, in accordance with FAR 5.301, 16.505(b)(2)(ii)(D), and 16.505(a)(4)(iii), notice of award of this action will be synopsized on the Contracting Opportunities website within 14 days of award and this justification will be made publicly available. This justification shall also be posted with the solicitation on the NASA SEWP V website for review by prospective offerors.
7. Actions to Increase Competition: In order to remove or overcome barriers to competition in future acquisitions for this requirement, the Government will continue to perform market research to determine if there are any new products or maintenance services available in the marketplace that would enable future actions to be fully competed.
8. Market Research: In November 2019, market research was conducted by the Government’s technical experts via internet research and review of industry publications to identify if there are other service providers or IAM software vendors with products capable of providing similar capabilities. Market research revealed that Hewlett Packard Enterprise LP; BMC Software, Inc.; and International Business Machines (IBM) offer similar IAM software solutions but cannot meet VA’s required software needs because these contractors cannot access the source code and technical data of the VA’s current proprietary CA Technologies IAM solution. The current CA technologies IAM software solution is an SoS, which consists of several subsystems integrated with proprietary data and source code owned by CA Technologies. The CA Technologies SoS IAM software solution will not interface with any other vendors IAM software solutions. The use of any other IAM software product would severely degrade VA’s ability to support and manage the existing IAM capability which would result in interoperability and compatibility issues. IAM software solutions from any other vendors would require an extensive and complex redesign, development, and integration of a new VA enterprise-wide IAM software solution. Any alternate solution from another vendor would be a cost prohibitive and high-risk alternative as it would require developing a proprietary IAM solution working through a cradle-to-grave software development life cycle for VA’s IAM software solution. The impact would be a complete redesign of the VA IAM and PIV solution which would take at least a year to complete and require a substantial dollar amount of new investment. The current system would still need to be up and available while redesigning the new system resulting in unnecessary duplication of costs and possible system downtime and/or loss or degradation of data as the system migrated. Each software developer offers a proprietary system and associated services that will only operate with its respective hardware and software. Based on this market research, only CA Technologies software maintenance and technical support can meet VA’s technical requirements.
In February 2020, the Contract Specialist conducted market research to ascertain the extent of limited competition among resellers of the required CA Technologies software maintenance and technical support. Through the use of the Provider Look-up tool on the NASA SEWP V GWAC website, 14 Service-Disabled Veteran-Owned Small Businesses were identified as resellers of the required CA Technologies software maintenance and technical support. Therefore, limited competition is anticipated.
