CHILD CARE SUBSIDY PROGRAM ADMINISTRATION

RFQ NO. NLR63310014C0001

1. BACKGROUND

The Office of Human Resources manages the Agency’s Childcare Subsidy Program in support of applicable Agency employees. On November 12, 2001, the President signed H.R. 2590 entitled, "Treasury and General Government Appropriations Act" into Public Law 107-67 which includes permanent legislation authorizing the use of appropriated funds by executive agencies to provide childcare services for federal civilian employees. This legislation provides agencies with the authority to use appropriated funds to improve the affordability of childcare for lower income Federal employees using or seeking to use childcare services.

Tuition assistance can reduce the amount of tuition parents pay for childcare by providing subsidies directly to the childcare provider. To be eligible to participate, a childcare provider must be a family childcare home or childcare center. Both types of care must be licensed and/ or regulated by the state and/ or local authorities where the service is provided.

The National Labor Relations Board (NLRB) is committed to providing childcare subsidies for lower income federal employees. Article 36, "Childcare Subsidies" of the Collective

Bargaining Agreement between the General Counsel of the National Labor Relations Board and the NLRB Union Covering Field Office Support Staff Employees establishes, consistent with budgetary considerations, a program to subsidize childcare costs to make childcare more affordable for lower-income federal employees. The program is consistent with P.L 107-67 and 5 CFR Part 792.

2. PURPOSE

The purpose of this procurement is to award a contract for the administration of the

National Labor Relations Board (NLRB) Childcare Subsidy Program which includes the disbursement of payments to licensed childcare providers who have provided childcare services for approved employees in the program.

3. TYPE OF CONTRACT

The National Labor Relations Board contemplates award of a Firm-Fixed Price contract for this requirement.

4. SCOPE OF WORK

Provide Childcare Subsidy Program administration and related work services. The Contractor shall provide all labor, materials, and equipment required to disburse funds to licensed childcare providers who have provided childcare services to NLRB approved employees participating in the Childcare Subsidy Program. The Contractor shall submit quarterly invoices to the NLRB to receive funds for disbursement to the licensed childcare providers.

Funds for the Contractor to provide childcare subsidy to licensed childcare providers for approved employees will be paid to the Contractor in advance of three months as outlined below under “Deliverables”.

4.1 TASKS

The tasks include, but are not limited to:

Perform all administrative tasks associated with the Childcare Subsidy Program;

Process tuition assistance applications and make a determination of eligibility and the amount of tuition assistance based on the tuition assistance determined by the

Childcare Subsidy Program. Issue written acknowledgement of receipt, and approval or disapproval of acceptance into the program to employees. Provide copies of the aforementioned correspondence issued to employees to the NLRB COR and / or

Program Point of Contact at the same time letters are issued to employees;

Provide the reasons for any denials that may occur and report denials at the same time an employee is notified of such denial;

Obtain appropriate tax income information annually from existing participants sufficient to recertify the participants' continuing eligibility to receive subsidies. Notify employees in writing of their approval or disapproval for continuation in the program.

Provide copies to the NLRB COR or Program Point of Contact of tax information received and annual correspondence sent to existing participants regarding their ability to continue in the program;

Notify NLRB COR or Program Point of Contact in writing (within 10 calendar days of the employee's removal) when any participant is removed, voluntarily, or involuntarily from the program;

Maintain confidentiality of all of the information contained in the Childcare Subsidy

Program applications;

Notify the parents and the childcare provider of the amount of the tuition assistance that each family will receive and the effective dates;

Ensure that those childcare providers who receive federal funds under the program are licensed and / or regulated by state and / or local authorities;

Ensure that licensed childcare providers understand that if, for whatever reason, the provider is no longer licensed and / or regulated by the state and / or local authorities, the provider will immediately notify the Contractor that administers the Childcare

Subsidy Program and employee whose child is enrolled in the childcare program. In such cases, the provider will no longer be permitted to receive the funds;

Receive monthly invoices for the tuition assistance amounts from the childcare providers; verifying services were received; and provide payments based on the invoiced amount no later than 30 days from the date of the invoice. The Contractor will pay the tuition assistance directly to the childcare provider, and not to the federal employee. The Contractor shall adhere to the following:

o Ensure that the childcare provider submits a written invoice, on a monthly basis, to the Contractor. Both the childcare provider and the parent must certify on the invoice that the care was provided;

o Tuition assistance will be quoted as weekly amounts and the invoices must be prepared using full week amounts unless services for the child end during a particular week;

Submit quarterly invoices which shall reflect the estimated total amount which will be required to fund the Childcare Subsidy Program to pay for the services of licensed childcare providers who have provided childcare services to approved applicants.

Invoices shall be submitted quarterly, to receive advance payment, prior to services being provided;

Upon receipt of funding, distribute payments to licensed childcare providers who have provided services as required;

Obtain new income eligibility guidelines from the NLRB COR or Program Point of

Contact by January of each calendar year. Apply new income eligibility guidelines as soon as they become effective each calendar year;

Administer program in accordance with the current NLRB bargaining unit agreement and/ or policy in effect. Current agreement for the Childcare Subsidy Program includes:

o All full-time and regular part-time bargaining unit employees with Total Family

Incomes within the schedule are eligible to participate. The benefit will be available to subsidize childcare expenses of the children, from birth through age

13, and disabled children through age 18, of Agency employees;

o "Child" is defined in 5. C.F.R. 792.215;

o "Disabled child" is defined in 5 C.F.R. 792.217;

o Children who are enrolled in year-round programs, school year programs, summer care programs, and part-time programs are eligible;

o The benefit will be available to subsidize childcare expenses of children of eligible employees who are enrolled in federally-sponsored childcare centers, non-federal childcare centers, and care in family childcare homes. The childcare provider must be licensed and/ or regulated by the state and / or local regulating authorities in the area of the childcares services. Agency payments for employees' childcare expenses may be made only to such licensed childcare providers, rather than directly to employees;

o When more than one parent works for the federal government, childcare tuition assistance cannot be awarded for the child / children by more than one federal agency;

o To obtain the subsidy, employees will submit a completed Childcare Tuition

Assistance Application Form (OPM Form 1643) to the Office of Human

Resources. Employees must attach the following documents to the application:

Leave and Earnings Statement for the most recent 2 pay periods for each parent or guardian;

A copy of the most recent federal and state income tax returns;

o Written acknowledgement of receipt and approval, or disapproval, of acceptance into the program will be issued to employees. Denials will state the reason for such denial;

o Employees whose requests have been approved will submit a completed Tuition

Assistance Agreement between Employee and Agency. The Agency will provide this form. The form will be completed each year;

o The Contractor will task providers to complete the Childcare Provider

Information form (OPM Form 1644), which includes appropriate license information or a statement of compliance with state and/ or local childcare regulations. License / compliance information will be needed for each child receiving a subsidy;

o The employee and childcare provider must certify monthly that childcare services were rendered. The Agency will provide appropriate forms for this purpose;

o The childcare provider must submit an invoice for payment to the program administrator. The Agency will advise providers of the name and address of the program administrator;

o The subsidy will be based on Total Family Income as follows:

Total Family Income" is the current combined income of both of the child's parents/ guardians (listed on their IRS tax forms as Adjusted Gross Income), reduced by any current state and/ or local childcare subsidy the parents / guardians currently receive;

The Agency's payment will be offset by current childcare assistance amounts received by the child's parents or guardians from local, state, or federal government sources. The subsidy may not exceed the actual amount of the employee's childcare expenses.

(h) Certification Regarding Responsibility Matters (Executive Order 12689). (Applies only if the contract value is expected to exceed the simplified acquisition threshold.) The offeror certifies, to the best of its knowledge and belief, that the offeror and/or any of its principals—

(1) o Are, o are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(2) o Have, o have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property;

(3) o Are, o are not presently indicted for, or otherwise criminally or civilly charged by a

Government entity with, commission of any of these offenses enumerated in paragraph (h)(2) of this clause; and

(4) o Have, o have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159.

The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).

(iv) The compensation (wage and fringe benefits) plan for all service employees performing work under the contract is the same as that used for these employees and equivalent employees servicing commercial customers.

(3) If paragraph (k)(1) or (k)(2) of this clause applies—

(i) If the offeror does not certify to the conditions in paragraph (k)(1) or (k)(2) and the

Contracting Officer did not attach a Service Contract Act wage determination to the solicitation, the offeror shall notify the Contracting Officer as soon as possible; and

(ii) The Contracting Officer may not make an award to the offeror if the offeror fails to execute the certification in paragraph (k)(1) or (k)(2) of this clause or to contact the Contracting
