About this file

This is a Justification for Other Than Full and Open Competition (JOFOC) document for a sole-source contract award.

The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) seeks to issue a firm-fixed-price sole-source contract to the National Law-Enforcement Telecommunications System (NLETS), a 501(c)(3) non-profit organization, for secure access to a nationwide computerized message-switching network that enables information exchange among law enforcement, criminal justice, and public-safety entities. The contract period runs from May 1, 2026, through April 30, 2031, consisting of one base year and four option years, with an estimated total cost that is redacted in the document. NLETS, headquartered at 1918 W. Whispering Wind Dr. in Phoenix, Arizona, currently charges a user-access fee of a redacted monthly amount, increasing to another redacted amount in January 2027, with uniform annual escalation of a redacted percentage through 2031. The Contracting Officer determined the pricing is fair and reasonable per Federal Acquisition Regulation 12.204.

ATF justifies the sole-source award under 41 U.S.C. § 3304 and Federal Acquisition Regulation 6.103-1, asserting that NLETS is the only responsible source capable of satisfying the requirement based on scope, reliability, and totality of records necessary to serve ATF's intelligence and law-enforcement information needs. Market research conducted in early 2026 identified no other viable competitors capable of providing credible access to the required interagency data. The Contracting Officer will post a Notice of Intent on SAM.gov upon approval and may issue a Request for Information in the future to identify additional potential competitors. The contract specialist is Amanda Boshears, and the estimated action value does not exceed the $750,000 threshold requiring branch chief review.

JOFOC No.:

Version MAR 2025

While this should remedy the restricted competition on future requirements of this technical nature, competition will most likely depend on the development of data exchange technologies within the local, state, federal, and international entities mentioned above.

As stated in Section 6 above, the CO will post this JOFOC, which is another way to remove/overcome competition barriers in the future. Also, the CO may consider issuing a request for information in the future to see if there are additional firms that can meet this requirement.
