This is a Project Manual and Invitation to Bid for New Kent County Public Schools in Virginia for the replacement of Rooftop Ventilation Units 7 & 8 at New Kent High School, located at 7365 Egypt Road, New Kent, Virginia 23124. The project involves the replacement of existing HVAC units and includes mechanical, electrical, and general building construction work. The work is divided into three trade categories: General Building Construction, Mechanical Construction, and Electrical Construction. A pre-bid conference is scheduled for May 20, 2026, at 10:00 a.m. at New Kent High School, with attendance strongly recommended. Sealed bids must be submitted by June 4, 2026, at 1:00 p.m. to Ms. Haynie Morgheim at the New Kent County School Board Office Building, 12003 New Kent Highway, New Kent, Virginia 23124, with public bid opening immediately following at the same location. Work may commence upon Notice to Proceed but is restricted from beginning on-site until July 6, 2026, unless the Owner grants prior approval. Substantial Completion is required by August 5, 2026, with Final Completion by September 4, 2026. The Contract Time is measured from the date of commencement. The drawing and bidding documents became available online through eVA beginning May 1, 2026, at no cost, with hardcopy versions available from a printing contractor at the bidder's expense. Pre-bid questions must be submitted to Ben Crismore at Thompson Consulting Engineers no later than May 25, 2026.
Bid security in the amount of five percent (5%) of the bid amount is required, submitted as a Bid Bond using AIA Document A310 or a cashier's or certified check made payable to the New Kent County School Board. Bids may be withdrawn by written request prior to the bid opening time; however, withdrawal after opening is permitted only under specific Virginia Code provisions for documented clerical errors. The successful bidder must execute the contract on AIA Document A101 (Stipulated Sum) and provide Performance and Payment Bonds each equal to one hundred percent (100%) of the contract price from a Virginia-licensed surety company. Progress payments will be made monthly at ninety-five percent (95%) of earned labor and materials, with five percent (5%) retainage until fifty percent (50%) of contract value is earned, after which retainage may be reduced to four percent (4%) at the fifty percent completion milestone and two and one-half percent (2.5%) at Substantial Completion. The apparent two lowest bidders must submit, within three days of opening, a list of proposed subcontractors for work exceeding $25,000 and identification of major product suppliers. No specific budget or award amount is disclosed in the documents. The Owner reserves the right to reject any and all bids, waive informalities, and negotiate with the lowest responsive and responsible bidder if the bid exceeds available funds. Liquidated damages for failure to achieve Substantial Completion are specified in the Supplementary Conditions of the contract. The Owner's representative is Timothy Pollock, and the Engineer is Thompson Consulting Engineers, represented by Bobby Little.

A. Bids may be withdrawn by written or telegraphic request received from bidders prior to the time fixed for the bid opening. Negligence on the part of the bidder in preparing the bid confers no right for the withdrawal of the bid after it has been opened except as permitted in Section 2.2-4330 of the
Code of Virginia as outlined below.
1. A bidder may withdraw his bid from consideration if the price bid was substantially lower than the other bids due solely to a mistake in the bid, provided the bid was submitted in good faith, and the mistake was a clerical mistake as opposed to a judgement mistake, and was actually due to an unintentional arithmetic error or an unintentional omission of a quantity of work, labor or material made directly in the compilation of a bid which unintentional arithmetic error or unintentional omission can be clearly shown
DOCUMENT INSTRUCTIONS TO BIDDERS 002113 - 5
by objective evidence drawn from inspection of original work papers, documents and materials used in the preparation of the bid sought to be withdrawn.

Owner must be accompanied with his original work papers, documents and materials used in the preparation of the bid. Such work papers shall be delivered to the Owner by the bidder in person or by registered mail.
3. Such mistake shall be proved only from the original work papers, documents, and materials delivered to the Owner as required herein.
4. Failure of bidder to submit his original work papers, documents, and materials used in the preparations of this bid at the time, date and place required, shall constitute a waiver of bidders right to claim a mistake in his bid.
5. No bid shall be withdrawn under this section when the result would be the awarding of the Contract on another bid of the same bidder.
6. No bidder who is permitted to withdraw a bid shall for compensation, supply any material or labor to or perform any subcontract or other work agreement for the person or firm to whom the Contract is awarded or otherwise benefit directly or indirectly from the performance of the Project for which the withdrawn bid was submitted.
7. If the bid is withdrawn under authority of this section, the next lowest responsive and responsible bidder shall be deemed to be the low bidder on the Project.
8. When the procedure set forth in the paragraphs above is utilized, original work papers, documents, and materials used in the preparation of the bid must be submitted in an envelope or package separate and apart form the envelope containing the bid marked clearly as to the contents.

B. Timing: The Engineer will consider requests for substitution if received within seven (7) days after the Notice of Award. Requests received after that time will not be considered.
1.15 PRE-BID CONFERENCE
A. A Pre-Bid Conference will be held at a date, time and place identified in the Invitation to Bid. It is a requirement for bidding that the bidders visit the site to confirm existing conditions, and pursuant to the form of proposal, bidders will declare their site visit and examinations and acceptance of site conditions.
