About this file
This document is a Limited-Sources Justification for the Negation of Improvised Non-State Joint Aerial Threats (NINJA) system support and maintenance contract for the U.S. Coast Guard (USCG) Patrol Forces Southwest Asia (PATFORSWA) area of responsibility. The USCG intends to limit competition to the original equipment manufacturer, Black River Systems Company, Inc., for a firm-fixed-price contract with a 5-year period of performance valued at $1,651,731.53. The NINJA system is a unique and highly specialized Counter-Unmanned Aircraft Systems (CUAS) capability, and Black River is the only authorized provider of support and maintenance services. The Contracting Officer determined this is the best value solution to meet the Government's needs. No other vendors have the required training or authorization to support the NINJA system.

Limited-Sources Justification
Pursuant to the Multiple Award Schedule Program (as authorized by 40 U.S.C. § 501), this justification is prepared in accordance with the requirements of Federal Acquisition Regulation (FAR) 8.405-6(c) for the use of sources limited to fewer than those required in FAR 8.405-1, FAR 8.405-2, and FAR 8.405-3. The circumstance justifying restriction is FAR 8.405- 6(a)(1)(i)(B) through the following facts and rationale:
(1) Agency and Contracting Activity.
The Department of Homeland Security, United States Coast Guard (USCG), Office of Contract Operations (CG-912) proposes to enter into an order or blanket purchase agreement on the basis of a limited-sources justification.
(2) Nature and/or description of the action being approved.

Company, Inc.

(f) Year of funding: Fiscal Year 2024
(g) Solicitation number: RFQ1724525
(h) Background information about the requirement: Black River Systems Company
(Black River) provides support and maintenance to the host unit on the Negation of Improvised Non-State Joint Aerial Threats (NINJA) system which is a system used for tracking and defeating Counter-Unmanned Aircraft Systems (CUAS) aircraft for Patrol Forces Southwest Asia (PATFORSWA) area of responsibility (AOR).
(3) Description of Supplies/Services.
The NINJA system requires annual software support and library updates, as well as a hardware warranty and maintenance. The contractor shall provide the services to support and maintain the NINJA system, as well as provide guidance on the host unit.
(4) Identification of the justification and the rationale.
FAR 8.405-6(a)(1)(i)(B) – Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized.
The NINJA system is the only system that can be used to track and defeat CUAS in the AOR, and Black River, the original equipment manufacturer (OEM) is the only company authorized to provide support and maintenance on the system.
(5) Determination by the ordering activity Contracting Officer that the anticipated order represents the best value consistent with 8.404(d).
The Contracting Officer has determined that issuing the proposed task order to Black River represents the best value and will result in the lowest overall cost alternative, considering price and administrative costs, to meet the Government’s needs. The ordering activity has considered the following:
a) Level of effort and the mix of labor proposed to perform the tasks is reasonable. GSA has already determined that the level of effort and the mix of labor proposed to perform the tasks is reasonable.
b) The total price is reasonable. GSA has already negotiated fair and reasonable pricing and a discount will be requested prior to placing an order.
(6) A description of the market research conducted among schedule holders and the results, or a statement of the reason market research was not conducted.
Market research was conducted to identify scheduled holders; however, no vendors available under those vehicles have the training or authorization to provide support and maintenance that is required on the system.
(7) Any other facts supporting the justification.
There are no other facts.
(8) A statement of actions, if any, the agency may take to remove or overcome any barriers that preclude the agency from meeting the requirements of 8.405-1 and 8.405-2 before any subsequent acquisition for the supplies or services is made.
The NINJA system has been identified as a commercial item and is currently approved for the USCG use. The NINJA system is the only system that can be used in the CUAS, and is only available from the OEM, Black River. The Government will continue to reach out to Black River to inquire about alternate vendors who they have trained to provide these services thereby increasing competition and removing limitations. Continuing to seek competition will eliminate barriers to competition.
(9) Contracting Officer’s Certification.
I certify that the data supporting the recommended use of other than full and open competition is accurate and complete to the best of my knowledge and belief.
