FACTS SUPPORTING A REQUEST TO ENTER INTO AN ACQUISITION USING OTHER THAN FULL
AND OPEN COMPETITION – SIMPLIFIED ACQUISITION (UNDER $250,000)
REQ no. Requestor: Tonya Lee Office Code Phone no. 301-827-3250
Introduction: Pursuant to Federal Acquisition Regulation 13.106-3(b)(3)(i), the following data is furnished to the Contracting Officer to support the requisitioning office’s request that the items/services identified on the above-mentioned Requisition be obtained using other than full and open competition. The requisitioning office understands that a contract may not be awarded on a sole source/brand name only basis unless the Contracting Officer approves Other than Full and Open Competition.
1. Identification of the Agency: HHS/NIH/OD/ORS/DATS
2. Nature and or/Description of Action Being Approved. Sole source.
3. Description of the supplies and services required to meet the Agency’s needs. The NIH
Back-up Care program provides emergency short-term care for NIH federal employees when their regular care arrangements are not available. This service provides in-home and center-based care for children and in-home care for adult-dependents. This program provides an invaluable service to NIH federal employees to continue their work when telework is not an option due to their primary responsibilities, such as patient care, animal care, and facility maintenance. This program directly impacts the agency’s ability to complete its mission. Since September 29, 2018, 416 requests have been made for care and 199 employees were able to report to work that otherwise would have had to take leave and potentially place the NIH mission in jeopardy.
4. Proposed Contractor’s unique qualifications
a. Proprietary data: As the current back-up care provider, Bright Horizons Children’s Center, LLC has an extensive registration process, national in-home and center-based care providers, and a reservation and payment process in place to meet the needs of the 1,557 registered NIH federal employees and their 2,433 dependents.
5. Additional Supporting Facts.
This action is necessary to implement a six-month extension for the NIH Back-up Care Program contract #HHSN263201400590P. This extension will permit NIH to explore a new contract model, establish a new period of performance that does not start on September 29th (the last 3 days of the end of the fiscal year), and to avoid disruption of services.
I hereby certify that the supporting data above forms the basis for this justification, is complete and accurate to the best of my knowledge and belief.
Certification by Requirements\Technical Personnel:
I concur and approve this justification for other than full and open competition.
