RFP No. NIHOD2012317

Am endment No. 2

Clarifications and Revisions:

1. It anticipated that 6 task orders will be set aside for either small businesses, SDVOSBs, or 8(a) companies.

2. Additional task order set asides are possible and will be determined at the RFPTO level.

3. The list of small business specialists for NIH can be found at http://www.hhs.gov/about/smallbusiness/osdbustaff.html.

Answers to Questions:

Q 1: Re Amendment 1, I must ask for further clarification regarding total number of references requested in the Technical Proposal.

5. Section L, 2.a.5 .d (Specific Experience) at page 53 is revised to state the fo llowing: The Offeror shall identify a maximum of 5 recently completed (within the past 36 months) or ongoing contract or task orders for animal care facilit ies which are similar in nature to the solicitation's scope of work.

6. Section L, 2.a.11(Past Performance Information) at page 57 is revised to state the following: a.

Offerors shall submit the following information as part of their Technical proposal. A list of the last 5

(maximum) contracts com pleted during the past 36 months and ALL CONTRACTS or task orders currently being performed that are similar in nature to the solicitation workscope.

1. Do you want 5 total (current and/or completed in past 36 months) or 5 completed plus ALL others ongoing similar in nature?

2. Also, would you prefer that TOs are listed as individual references, or would they all fall under the umbrella contract (for this purpose) as one contract, and we would therefore provide an additional four references (if 5 is the max)?

Last, I interpret the RFP so that there will be one identified section in the Technical Proposal for

Specific Experience/Past Performance (so that the two above comments are incorporated into one section) and that the two descriptions in RFP are sim ply a redundancy. Can you confirm there is only the one section requested?

A.1: Please submit no more than five (5) (total) recently completed (within the past 36 m onths) or ongoing contract or task orders for animal care facilities which are s imilar in nature to the solicitation’s scope of work.

http://www.hhs.gov/about/smallbusiness/osdbustaff.html

Task orders would fall under the umbrella contract, and additional four references would be permitted. One section requests this specific experience be included in the technical proposal submissions

(Section L.2.a.11) and the other limits the number of pages that may be submitted for each contract summary. (L.2.a.5.d.) Additionally, the business proposal must also include a sum mary of general

(corporate) experience, to include organizational experience, performance history, and pertinent contracts.

Q. 2: Please clarify how task orders are being classified for sm all businesses and SDVOB set-a-sides. W ill there be 8(a) opportunities. If not why is this not being considered? Is there a dollar threshold limit for different categories? What is the basis?

A.2: Task orders will be classified for small business and SDVOSB set-asides on a case by case (task order by task order) basis. There may be a possibility for 8(a) opportunities if two or more contracts are awarded to 8(a) businesses. Please see A.3 below, and

Clarifications, above.

Q. 3: There was a reference to SDVOB companies receiving opportunities to bid on of a $100,000 value on page 45, for low complexity work. Is there a pre-determine selection process SDVOB companies can only perform low complex work? Please clarify was there an error in the $100,000 amount. There may have been a typo to show $1,000,000. It does not appear a $100,000 effort would not support a task.

A.3: Sections L.b. and L.c. are revised as follows:

b. NOTICE OF SMALL BUSINESS SET-ASIDE

(1) General. Tasks of low to moderate technical complexity with an annual IGCE of $500,000 or less will be set aside for sm all businesses. It is antic ipated that three tasks will be set aside for small business competition. Accordingly, this procurement will be awarded to one or m ore such concerns, organizations, or ind ividuals. This action is based on a determination by the Contracting Officer, alone or in conjunction with a representative of the Small Business

Administration, that it is in the interest of maintaining or mobilizing the Nation's full productive capacity, or in the interest of war or national defense program s, or in the interest of assuring that a fair proportion of Government procurement is placed with small business concerns.

(2) Definitions. The term "small business concern" means a concern, including its affiliates, which is independently owned and operated, is not dominant in the field of operation in which it is bidding on

Government contracts, and can further qualify under the s ize standards in this solicitation. In addition to meeting these criteria, a small business concern submitting an offer in his own name shall furnish, in the performing the contract, only end items manufactured or produced by small business concerns in the United

States or its outlying areas, provided that this additional requirement does not apply in connection with construction or service contracts.

c. NOTICE OF SERVICE-DISABLED VETERAN-OWNED SMALL

BUSINESS SET-ASIDE

Tasks of low to moderate technical complexity with an annual IGCE of

$250,000 or less will be set aside for SDVOSB competition. It is anticipated that three tasks will be set-as ide for SDVOSB com petition.

In accordance with the "Service-Disabled Veteran-owned Small

Business (SDVOSB) Procurement Program" authorized by the

Veterans Benefit Act of 2003 (15 U.S.C. 657f), offers on designated task orders will be solicited only from Service-Disabled Veteran-owned Small Business concerns.

At the time of proposal submission, a service-disabled veteran-owned small business (SDVOSB) concern must represent to the Contracting

Officer that it is a SDVOSB concern and is considered small under the

North American Industry Classification System (NAICS) code assigned to the solicitation.

Offers received from other than SDVOSB concerns shall not be considered on task order requests for proposals which have been set-aside for SDVOSB concerns.

Q. 4: If sm all businesses can perform the work will task orders be placed in a small business category. I understand small businesses can bid on large business task orders but this seems to defeat having a small business program if the task order automatically goes to large businesses.

A.4: See A.3 Task orders are not automatically given to large businesses.

Please see clarification #2, above.

Q. 5: In the past companies without NIH experience could not score high enough to win awards. What has changed so that experience from other government, academic and corporate contracts will have value in competing with companies that hold the current work at NIH.

A.5: There are no bonus points given to companies whose experience was performed at NIH. See RFP Section M, Evaluation Factors for

Award.

Q. 6: Please explain why 541940 is the code for LARC III.

541 -- Professional, Scientific, and Technical Services/541940 -- Veterinary Services This appears to be more general for actual veterinary clinic work. In the past the LARC used more appropriate NAICS codes. NAICS 541711 and 541712 provide a more clear reference to biomedical research support. Research and development in the physical, engineering, and life sciences

Can you clarify if 541711 and 541712 would be used as they have in the past. 541940 has been used for Veterinary support is primarily used for animal clinics and the farm animal work for USDA.

In addition, using 541940 limits the use of small businesses on the LARC because of the dollar threshold. 541711 and 541712 provide m ore advantages to small businesses.

See 541940 description:

A.6: NAICS codes are chosen based on the primary purpose of the procurement. Please see SOW .

Q.7: Amendment 1 to the RFP, Question 7, RFP Section L, Page 61, Para. 6. This is a follow-up to the answer NIH provided. Does NIH have a minimum goal (expressed in percentage of the total estimated cost of the contract) for Small Disadvantaged Business Participation for this solicitation?

A.7: The NIH minimum goal for SDB participation is identified at the bottom of page 1 of the small business subcontracting plan form. See attachment

9 of the RFP.

Q.8: Amendment 1 to the RFP, Question 15, concerning RFP Section L, GENERAL INSTRUCTIONS, Para. 4. “Separation of Technical and Business Proposals”. The NIH Answer to the question states that no cost information is required and refers to Clarification 1 of the RFP Amendment which deletes the “Technical Proposal Cost Summary”. However, Amendment 1 to the RFP did not make any adjustment/deletions to the wording in the Para. 4 referenced above. This is a follow-up question: Is any resource information required in the Technical Proposal, such as proposed labor categories and associated hours and wage rates (not fully loaded)?

A.8: No cost information should be included in the technical proposal.

Q.9: RFP, Page 38. Section J, Attachments. We are unable to access Attachments 20, 21, and 22.

A.9: The documents accessible from those links are attached to th is

Amendment 2.

Q.10: For proposal purposes, should we assume February 1, 2013 is the start date for the first awarded task order or the award date of this contract?

A.10: No. Task orders will be com peted after the contracts are awarded. It is antic ipated that the contracts’ period of performance will begin

February 1, 2013.

Q.11 Please confirm that there are no key personnel designated for this contract except as specified in a

RFPTO.

A.11: Yes, that is correct.

Q.12 The listing of responses to a task order shown in this reference covers areas which will be covered in the response to this proposal, specifically the provision of past performance information. Further it implies that resumes of all proposed personnel must be included with the response to the RFPTO.

Please re-evaluate these requirements.

A.12: Resumes of proposed key personnel only, need be submitted.

Q.13: Does the Government intend to incorporate a new W age Determination at the beginning of each Task

Order option period?

A.13: No. Wage Determinations will be incorporated annually, throughout the contract’s period of performance.

Q14.: Article H.8 E.1- Please provide the Information type appropriate to the referenced Article.

A.14: Mission Based Information.

Q.15: Are resumes submitted in response to the Personnel and Staffing response included in the page count?

A.15: No. However, the individual’s qualifications must be described in the

P&S narrative. See Section L. 2.a.5.h.

Q.16: Page 53 & 57. The instructions for Past Performance information are in conflict as to the number of references and the information provided. Please clarify.

A.16: See Amendment 1 to RFP, Clarifications 5 & 6.

Q.17: The instructions for the First Page given on page 40 are different from the instructions for the Cover

Sheet on page 58 for the Business Proposal. Are both necessary in the Business Proposal.

A.17: Yes. The cover page must include the RFP title number, name of organization, DUNS No., identification of the proposal part, e.g., business or technical proposal, and indicate whether the proposal is an original or copy. The first page of the proposal must show the information stated on page 40.

Q.18: The Business Proposal Cover Sheet requests the proposed price, fee and total. What should we enter?

A.18: Indicate the price, fee & total based on one person for each labor category.

Q.19: In the SOW , Section IV, Two documents (NIH Chemical Hygiene Plan and Laboratory Safety at the

NIH) are re ferenced with “??” in th is list. Is it possible to get an electronic copy.

A.19: See:

http://www.ors.od.nih.gov/sr/dohs/Documents/NIH%20Chem ical%20H ygiene%20Plan.pdf

The Laboratory Safety docum ent is removed from the list.

Q.20: W hy has the NAICS Code and Size Standard been changed to 541940 from 541712. Based on the description of services provided in Article B.1, The Government intends to buy a wide variety of support tasks not related to veterinary services. The existing contract uses 541712 which may better describes the services required. Very few, if any, of the existing incumbent contractors will be considered a small business under 541940.

A.20: The existing LARC contract does not utilize NAICS code 541712, but was incorrectly coded as 541710. Additionally, see A. 6, above.

Q.21: Can the Lark (sic) III have a process where opportunities are presented to small businesses first to see if they have the capability to support a task order?

A.21: In addition to the processes previously followed, i.e., Sources Sought

Synopsis posted on www.fbo.gov, processes may be considered at the task order level.

Q.22: W hy is this RFP not considered a Research and Developm ent requirement? W as Lark II a Research and Development requirement?

A.22: Please see Attachment 3 to RFP, SOW , for a description of the requirements perta ining to this procurement.

http://www.ors.od.nih.gov/sr/dohs/Documents/NIH%20Chemical%20Hygiene%20Plan.pdf http://www.ors.od.nih.gov/sr/dohs/Documents/NIH%20Chemical%20Hygiene%20Plan.pdf http://www.fbo.gov, Q.23: Please advise if the training described in the RFP sections listed below will be considered allowable costs to be paid by the Governm ent or if costs are to be borne by the Contractor? If the labor/cost is not billable to the contract, is there a typical time period for completing the training?

ARTICLE H.8. INFORMATION AND PHYSICAL ACCESS SECURITY

Page 23 - Section D.e – Contractor and subcontractor employer training
