JUSTIFICATION AND APPROVAL
FOR OTHER THAN FULL AND OPEN COMPETITION
(under $100K)
1. Contracting Agency: U.S. Army Engineer District, Corps of Engineers, P.O. Box 59, Louisville, KY 40201-0059
2. Description of Action: This justification supports an out-of-scope modification associated with the make-up air units in Buildings 907 and 902 (B907 and B902) at Niagara Falls Air Reserve Station, New York. The contract action will allow for the system to be cleaned/flushed removing sludge currently in the system which is impacting the ability of the system to condition (heat) B907 and B902. The cleaning of the system is estimated to cost less than . Project will be funded with SRM funds.
3. Description of the Supplies/Services: The Contractor shall perform a cleaning of the entire glycol system that supports B907 and B902. This shall be executed through the installation of a filter/feeder cleaning process that will remove contaminants within the system. Contractor shall add a biocide to treat the bacteriological growth within the current system, and implement a routine schedule for filter changes through the duration of the cleaning process. This change shall include all associated measures and costs to clean the system in its entirety, which includes commissioning.
4. Authority Cited: 10 U.S.C. § 2304(c)(1); FAR 6.302-1 – Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited: Louisville District Contract W912QR-17-C-0042 is for the renovation of B907 at Niagara Falls Air Reserve Station, New York. The B907 renovation contract included replacing the glycol system; it did not include cleaning the system. While the contract is for the renovation of B907, a portion of the glycol system also serves B902 which is connected to B907. Through visual inspection and lab analysis, it was determined that the current glycol system is clogged with material and biological debris, which is believed to be coming from the old existing piping associated with the old heating system from B902. Because the glycol system serves both buildings, the materials and biological debris that are believed to be coming from the old piping in B902 is affecting the new system installed under the current contract. Under the current contract for B907, the government is entitled to warranty services associated with the B907 system and workmanship. If the government were to use another contractor for the cleaning/flushing of the system, it may impact the warranty coverage. Additionally, the original contractor would still have to coordinate with the other contractor if problems were found during the cleaning process in order to determine whether it was covered by warranty or not, resulting in duplicated cost, time, and effort to the Government.
6. Efforts to Obtain Competition: N/A. No effective competition is anticipated for this acquisition due to the reasons stated above.
7. Actions to Increase Competition: N/A. No effective competition is anticipated in light of the reasons stated above.
8. Market Research: Market research was not performed in view of the reasons cited above.
